Thank you Mistermind (check your scales ) - I'll got for option 2 (£5) and try and push it through as quickly as possible...Hopefully as it is such a small claim they will not bother messing about and pay me out as quickly as possible. Although in saying this I'm fully prepared to go off to court if they want me to

    TheDean Vs Egg

Hi all, Like many I have had my Egg card changed to repayment only for being 'high risk'. I have preiously been a good customer and certainly would not think of myself as high-risk. I originally wasn't going to claim back the charges they have livied on my account as I think it is just a shade over £100, but due to their behaviour in regards to my account, I have decided to claim back every penny - going to court if neccessary! I have previously claimed back charges from RBS (before it was all escalated to the High Court) and although a reasonably lengthy procedure, was simple enough. I have sent the below letter today and will update this thread with everything I recieve from them if I need help etc etc etc. Dear Sir/Madam, Data Protection Act 1998 Subject Access Request Please supply me with a complete list of transactions and charges relating to my accounts for the last six years. Alternatively, a complete set of bank statements for that period will be acceptable. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my financial business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties and charges against me, then I shall be reclaiming them. If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However please note that by sending this secure message I have passed through your security and thus confirmed my identity. Yours Faithfully, TheDean
  8. I also have had my account removed. I paid off the entire balance (about £1800) off in one go at the tail end of last year and have been making sure I pay the full balance off each month now. I wasn't going to bother claiming charges as i think it's just a shade over £100, but now I am....
  9. TheDean Vs RBS - WON!! Full amount requested Awarded :D
  10. I had a brief flick through it last week, apparently it's not worth the paper it's printed on anyway from a legal standpoint. Did you re-word yours?
  11. Cha-Ching!:o :o Recieved the E-Mail below: Dear TheDean, I am advised that a further offer letter will be despatched to you in the next few days, this will meet with your claim in full. Please be advised, that for legal and audit reasons, we require to have the signed acceptance letter returned to us, a faxed or e-mail copy is not acceptable. A reply envelope will be included with our letter. Regards Sandy I'm not opening the Champagne till the £££ is in my account though!!!
  12. Sent this: Sandy Watt Customer Relations Ground Floor The Forthstone 56 South Gyle Crescent Edinburgh Depot Code 045 Response to settlement offer. Dear Sandy Thank you for your letter dated 4/05/07 I respectfully decline your offer of Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totaling £XXX.XX I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary. I have been very disappointed with the way this claim has been handled up to this point by your team. I am aware that there is currently a massive influx of claims at the present time due to media coverage, however, I believe my claim has been handled particularly badly. I have waited patiently, due the high demand of charge claims, for over 8 weeks now, and only the threat of court action forced an ‘offer’ by yourselves. I am aware of the pressure you must be under, but this is simply unacceptable in terms of levels of service to your customers. I was told on three separate occasions that a manager would call me back to discuss my claim, these phone calls never happened. I was also informed by a member of your staff that the claim would be ‘Escalated’. When I called back a week later not only was there no escalation, but there was no record of my call whatsoever! I do hope this e-mail is dealt with as a personal matter of urgency by yourself Sandy, and your team members. If I do not receive a full and final offer of £XXX.XX by 18/05/07, I will be forced to begin legal proceedings. This would be a real shame as I have always been very happy with my branches in XXXXXXX and XXXXXX. The staff have been very helpful in branch at every stage, and I have no desire to leave the bank due to this reason. This date of 18/05/07 will have given the bank over 10 weeks to deal with this claim, and return all charges back accordingly. Both myself, and the regulator, believe this is more than a reasonable time for this to be dealt with. I look forward to hearing back from you soon. Yours faithfully TheDean
  13. Right!!! Finally got an offer, which means we are getting somewhere - £617.32. I am going to reject it of course, but I am please the claim is moving forward at least. Does anyone have a good letter they used to 'accept offer as part settlement only' please?
  14. I meant I had already previously added INT charges at both previous stages. This is really starting to drag on now.....still nothing from RBS
