Hi All

 

I just phoned Monument to pay off all I owe apart from what I am claiming for through the court. I was told that they have passed by debt on to Cabot - NOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOOO!!!!!!!!!!!!!!!!!!!!

 

I rang Cabot and they said that it has only happened within the last few days so it isn't on their system yet. They confirmed that they have bought the debt.

 

Is this allowed when there is a court case in progress? Should I write to the court and inform them as the hearing is next month?

 

Also should I pay off what I owe still or go through the chasing of original deed of assignment?

Something else. I have just dug out the notice of allocation to the small claims track and it says that I had to get all my paperwork to the court by 24th January. I missed the flaming deadline. What do I do now?

 

Also there is a bit that says:

 

The issue of the identity of the defendant will be tried as a preliminary issue at the final hearing and if it is found that Barclays Bank plc is the correct defendant the matter will proceed on the basis that the defence filed is that of Barclays Bank Plc. What does this mean?

I didnt file any more paper work when I submitted my AQ. I had already supplied the paperwork (X3) to the court when I filed my claim. I am getting worried now!

I'm worried too! All my other battles have been sorted by this stage. Terrified of going to court. Especially if the Monument/Barclays thing bites me on the behind!

I really dont want to go to court but I will if I have to, it is MY money they are trying to take from me so I am determined to see it through to the end.

Me too. It's just that I don't like to be made to look a fool so if I get to court and lose through lack of knowledge/preparation I will kick myself!!

I'm about to send my request for repayment to Monument, I sent the last letter to customer services, does anyone have a name or different address to send the repayment letter to?

Just keep firing them off to the same address. If they don't reply to your requests in that time that's their problem. I eventually got correspondance from someone after sending my letters to customer services so hang in there.

what address pdolan did you state on your claim form then as Monumnt is only a trading name of Barclays bank i have put the registered address as the barclays address at the bottom of the letters?

Can anyone tell me how long it took to get copy statements from Monument. I am taking them to court for a friend the cheque still hasn't been cashed but still only 2 weeks.
