Mondeo, just to let you know that after a bit of a struggle with the people at blue amex phone banking i got all my statements. They arrived all neatly packaged in one bundle. In fact I thought it was Christmas....especially when I thought about how much this prezzie could be worth. I also have a few phone numbers that may be helpful in your dealings with them in future. I'll post them in my thread. I think that when I mentioned a ' Pending legal action' the chap on the phone gave in! I think I had to ask for the supervisor three times before actually getting to anyone who could make a decesion. In the end I got them all free. Good luck.....I did think it is worth persisting on the phone before applying under DPA as you can really get the ball rolling rather than having to wait for 40 days.

Thats 4 in the BAG!!!!

so crooked they use a corkscrew for a ruler!(allegedly)

DPA Request Expired ! Nothing recieved

 

Tried phoning them yesterday, all I got in broken english was "sir I am sorry to say that we do not have a data protection department", then "sir I am sorry to say that we do not have a legal department"

 

Nightmare.

 

I have spoken with IC's office, they are sending me a complaint form.

 

In meantime GomadNomads given me an alternative address to write to, so am going to try repeating the request.

Saga continues,

 

21 days after my 2ND DPA request letter they send me a form "Data Disclosure Request Form", it also asks for the £10 which i've already sent, and a copy of a driving licence or passport.

 

This has now been going on since 27th February.

Got my statements, statements only though not Data Protection Act response

Sent preliminary request 9th May £165

Recieved this response 10th May

 

Dear Mondeo,

 

Thank you for your letter dated 9th May, recieved in this office on the 10th, and for allowing us the opportunity to deal with your complaint.

 

We are currently in the process of investigating the issues you have raised. Please be assured that you will recieve a response within 28 days from receipt of your contract.

 

Please find enclosed a copy of our complaints procedure.

Recieved a second response day after, must be a stock response

I refer to your letter recieved in this office 10th May 2006 concerning the default charges levied to your account.

 

Whilst I appreciate your comments concerning the recent announcement by the Office of Fair Trading, American Express maintains that our charges are fair and reasonable and are avoidable by complying with the Terms and Conditions of our agreement with you.

 

We are, however, going to be reviewing our charging policy with respect to default payments in light of the OFT recommendation, but no decision has been made at this stage. In the meantime our existing charges for defaulting on payments will stand.

 

American Express will notify our card members of any future changes to our Terms and Conditions

 

I trust this clarifies the matter.

Got a cheque this morning from Sylvia McAllister, the letter was even really signed by her and it wasn't without prejudice which makes a change.

 

I'll post full letter later however one interesting bit says that from now on, in light on the OFT recommendations the default charge will be £8. It says this charge represents the administrative expenses of dealing with defaulters and is calculated using the OFT's points.

Well done on receiving your refund:D

In the end did you have to file with moneyclaim? Just wondered as you posted nothing after your LBA had been sent. Only interested as I will be at that point next week with Amex.
