Just had a call from Rachel Hinchcliffe at HBOS Legal Services, informing me that she has had a look at the interest (0.022% = £6.47) on my claim and she agrees that I was right! Anways, the monies will be deposited in my account in the next few days. I told her that as soon as I have the monies, I will inform the court that Halifax has settled.

 

I will get back every last penny.....

In all the excitement this is easy to forget - you hold out for it my girl. They want you to let the court know that settlement has been made...well, when you get your money...etc...etc...etc...

Very glad to see you claiming that back too.

 

I have a sticky in the forum that highlights the fact that Halifax seem to be very forgetful when it comes to daily interest!!

Update...

Just got tipped off by ArthurC to check account and £6.47 CASH has been deposited. This means that finally this matter has now been settled in FULL and I will inform the court tomorrow.

Got there in the end! Well done. :)

 

I've applied for a default judgement on the £630 that's still outstanding on my second claim and started a new claim on the joint account for charges since the initial summons was raised. It's a never-ending battle! :(

Can you give me a bit of help....when you put your claim into court and you did the particulars of claim the bit about how much your claiming in 5 a) the return of the amounts debited etc, did you put the whole amount including the interest debited or do you put the charges down as a separate value....lm a bit confused to be honest and l did put something on my thread but no one came back and l want to go to court tomorrow to file

Hi Marilyn - I put the amount claimed AND interest. I made the mistake with my first claims and only put in the amount claimed. Luckily I did specify the amount of interest in the particulars and were able to get that back.

Received letter from Halifax credit card two weeks ago. They would not repay any charges since they were agreed in the original agreement. I replied that I would give them fourteen days to change their mind and then issue proceedings.

Yesterday, wednesday, I received a further letter confirming that they would repay the charges in full, £350, on a full and final basis. just waiting for it to be paid into the bank now.

Thanks for that, just one more thing do you know the daily rate of interest as l have to put this on the claim....l think its something like 0.022 lve read it somewhere but do you think l can find it!!! lm really quite nervous now its come to the actual claim so l want to get it right!!!!

one last quest, l bloody hope, on the online help on MCOL it says:

 

You must then work out how many days have passed since the date the invoice was due until the date the claim is issued. Not only must this be stated in the particulars of claim, but this figure must also be added to the amount you are claiming

 

What exactly does that mean, is it the date from which l initially asked for copies of my charges, 19 may, or does it mean another date that lm really not seeing....

 

See said l was being thick and the brain is all muddled with the heat, this claim and how bloody nervous l am lol

Hi

 

I got confused about this too - but in the end I worked out the 8% interest for each chargem dating from the time the charge was incurred, and added it together. I put this figire down and then put the date of the first charge as the start date. I am very near settled at the moment (just waiting for the cheque to reachmy sticky little mitts) and no one has brought this up as a potential problem.

So let me get this right the 0.022% is the same as the 8% charged on the spreadsheet, lm obviously having a really bad time at the mo... think its all starting to fall into place doh!!!!!!!!!!!!!:)

Whoops, think I misunderstood, I was talking about the claim form! Did you put a daily interest rate on the claim form? I think you are supposed to, to ensure you are entitled to it. It does work out at 0.022% of your entire claim per day.

 

All this means is that since the date you put the claim in, you have still been accruing the 8% interest. Therefore they are asking you to work out how much extra is owed. Simply count the number of days from the date your claim went through, until the date of settlement, and multiply it by the daily interest.
