Section 7, Part 1 of the Unfair Terms Of Consumer Contracts Act 1999 states:

 

7. - (1) A seller or supplier shall ensure that any written term of a contract is expressed in plain, intelligible language.

 

 

Given how most banks' Terms and Conditions booklets are written in tiny print, and generally tend to be a bit baffling, could this be presented as another breach of the Act by the banks, and used to strengthen the case against them if it winds up in court?

Interesting dilemma would present itself - if you used this argument (reasonably I hasten to add) you would then be in the position of explaining how you were so confident that the terms you are sueing against were unfair...:rolleyes:

Because I've got an IQ of 177, and I work in accounts, so I'm used to reading particularly obscure and confusing documents. :) Point taken, though. It'd just be nice if there was a way of forcing banks to make their terms simpler.

I think the point I was trying to make was that you could use one argument or the other, but not both.

 

However, compelling the banks to amend the layout/language could be argued by a third party, on behalf of everyone else...and in this the dilemma could be addressed by a person with knowledge of the constituent elements...
