UKPC charge - member of BPA association

- I made the mistake of parking in mc Donald’s for 1hr 49 mins.  19 mins over the restricted time period.

The charge is £100 but £50 if I pay within 14 days.

 

My question is

I have read that legally I can’t be charged  over £50 but the notice is for a charge of £100????

I didn’t read the signs.

I have two online transactions spent in there over that period.  

my daughter was playing in play area hence being in there for that time.

 

I don’t think I have any exceptional circumstance to plead I didn’t read the signage but it is the charge that I can dispute?

 

Has anyone had previous experience in this matter

We have several McDonald's-UKPC threads.

 

UKPC are total charlatans and McDonald's head office, from what we've seen, will not call their dogs off.  However, you could still try.  The CEO's e-mail address is  https://www.ceoemail.com/s.php?id=ceo-8918

 

You might have more luck contacting the manager of the branch where this happened.

 

BTW, what you have received isn't a fine, a private company doesn't have the power to fine anyone.  It's an invoice.  UKPC often don't send out their invoices in accordance with the law so please upload it and fill in the forum sticky -

Not reading the signs is probably the reason you overstayed and that is not a defence in law. if the signs were too small or facing the wrong way or there wasn't one at the entrance those could be valid reasons. 

Sadly the £50 limit is not in force at the moment.

If you could answer the questions on post 2 there might be something on the PCN that could help your defence. Also if you could please take some legible photos of the signs at the entrance and in the car park that could also help you. Despite the fact that the Act covering private car parks has been in force for over 12 years it is beyond the ability of some of the  the parking companies to get the legal requirements right so you are still in with  chances even if Mc Donalds do not help.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
