Hi I am new here and I have been reading various posts but I can not see anything that could potentially help.

 

I have had a letter from the court advising me that Anglian water have applied to put a charge on my property of £700 and the costs are £500.

 

I have a family member who who can help me to pay this

 

having spoken to anglian water - they said I can not pay it and that the charge has to go on my property first.

 

someone please help me here?

Hi dx thanks for replying to my post.

I did not get one that is why and if I had I would of acted on it. Moving forward I just want to know what I can do to stop this, even if it means paying.

they cannot just get a charging order, they have to return to court, of which you would be advised and then embarrass them in court by telling the judge they have refused payment, which they cant do.

 

you really need to stop using the phone, writing only.

 

now on to how you might be able to kill the whole thing.

 

why did you not received the 10's of letters before the court claimform, the letter of claim they must send prior requesting northant bulk issue the claim?

 

have you moved in recent times and this was an old water debt from an old home you lived at.

Hi Thanks again.

I made a mistake my bad:-( I did receive one and I defended it and it was set that I was to pay an agreed amount.

 

I assumed the payments were being taken but I learnt they were not when I received the letter about the order relating to my property.

 

It is no excuse I know but, I lost my mum a couple of years ago, I lost my job and again, lost my job just recently, times are tough for me since losing my mum.

This may be unrelated to this topic but I thought you could direct me to appropriate sources of help.

I got CCJ claim forms from a debt company. Mistakes of youth and failed relationship. Most were credit card debits. I met the father of my child and in order to get set up and new house I used my cards to the max. We split up soon after and I wasn't able to pay back. I am still not.
It will soon be six years since I went into debt.
 

They sent me a letter saying its last time before they will go to court. 

Is there anything i can do about it?

no to the COURT!!

 

and anyway if the CCJ is only in ONE of your names then all the CO will be is a restriction K ...absolutely useless to them as it wont force payment

nor force a sale

nor ever need paying.

The court can only order a sale where:

the debt is in your sole name and you are the sole owner of the property, or
 the debt is in both the names of the joint owners of the property.
 If the debt is in your sole name and the property is in joint names, the creditor could apply for an order for sale to realise their interest in the property, but it's all but useless.  Your creditor will have got an interest in your share of the property if/when the final charging order was made.
