      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Given potential action by a certain legal company, I feel the need to issue a retraction and an apology.

 

I apologise unreservedly for the implication that the reporting of the Express and the Mail was anywhere near the level of utter cretinous doodoo posted here by a certain forum member.

I acknowledge that in sharp contrast, both the Mail and the Express do not exclusively post horsecrap and occasionally actually do on occasion include honest and somewhat intelligent observation and reporting, albeit not often.

I also acknowledge and agree that they are not entirely responsible for the cretinous horse **** posted in their comments sections or the almost exclusive use here of the less reputable articles they and others print.

In the meantime, the new chancellor has reversed the tax givaways instigated by Truss the (absent) Piers Morgan and Kwasi the Kharsi, which the OBR is expected to report will cover just about half the trashing of the economy instigated by these utter tosspots.

There is speculation on social media that Truss may have rushed off to Ukraine,

copying a favourite Boris Johnson tactic (when) faced with domestic mayhem of his own causing.

 

... as bankers 'bonus cap relief' seems largely the only aspect of the Truss budget that hasn't faced reversals

... and £30B+ in service and benefit cuts seems likely to fund that and Tory mismanagement

So, given that Hunt is already spouting how proud he is of what they have done for to the NHS, and given its on its knees even before the expected winter onslaught .. thanks to him and his oppo's

Who thinks NHS budgets are going to suffer more and quickly in Hunts drive to shunt profit to the private sector he is so heavily invested in

 

Maybe not if he thinks a little bit of patience before ripping off more patients will boost his chances of getting even more a little later?

Not too much patience though - clock is ticking

Truss stands by defence spending rise

"Liz Truss made an “unequivocal commitment” to increasing defence spending to 3 per cent of GDP by 2030 at a meeting with the European Research Group (ERG) of Brexiteer Tory MPs.

 

ERG chair, former minister Mark Francois, told reporters after the gathering: “We were delighted to hear her make an unequivocal commitment to spending 3 per cent of GDP on defence by the end of the decade.

“She was asked very specifically about that. She was very clear that that commitment remained."

Truss allegedly said to the ERG that she found it “painful” to allow her tax cuts (for the rich and their businesses) to be abandoned but she U-turned “because she had to”

 

 

So, Everyone braced for austerity 2 , bigger, nastier and deeper for the little people, with even more enriching the rich and profits for pals

 

Energy prices already doubled, and will likely go up at least another 50% come April, with taxpayers paying to ensure record profits for energy companies

Thought waiting 8 hours for an ambulance, then another 8 hours at A&E was bad - those will be the 'good old days'

 

Noticed the shelves on the supermarkets getting constantly thin, rather than occasionally ?

Noticed diesel gone up 2p a liter just over the weekend ?

Seems even worse than it at first seems to me as Truss is saying to Mp's including Hunt, you may have said Fracking is a problem not a solution, but unless you trash your word to vote as i say you will have the whip withdrawn and face a general election where loads of you will lose your seats

 

So shes slash and burning in a way even Johnson didn't - perhaps not given the chance.

Her resignation letter is a farce - they send gov business out from private emails and whattsapp on a daily basis, and trashing election pledges generally has not bothered her in the slightest - until it suites
