South West Water chasing 2014 CCJ payment

Okay, so I phoned SWW.

They said there was a CCJ .......8 years ago in 2014 ?!

Is that legal, can they wait until the ccj is gone and then chase me again for the same thing ?!

yes as they sometimes do.

the last round of these we had was via shuman sols that claimed there was a CCJ but turned out there never was in several cases here.

 

theres no have in wring back, even staple a copy of their letter to yours

ask them for the Judgement CCJ claim number , date, and at what court the CCJ was attained at.

 

this will also get everything sent to your correct address too

they would have to return to court to request use any bailiffs

of that there is generally a 6yrs rule (though not under statute barring as a CCJ can never be statute barred)

it is extremely rare any judge would grant enforcement. and anyway as far as i know, you would be informed of the request to enforce and could tell the court so/why.

 

lets put it this way. lets say they did...its a consumer credit debt, there is not right of forced entry anyway so not much the bailiff could do anyway.

say they did go back to court, would I get a chance to have my say and say this is why I haven’t paid the buggers!!!!

Yes in theory if the Courts allowed more time to collect and Enforcement was appointed they could look to seize property you own from outside your house.

Do ensure that South West Water are made fully aware that they can communicate with you at your current address.  Put it in writing and get proof of postage.

 

Water companies can be very naughty by providing Courts with a previous address,  if this is a possibility in your case.
