      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If it's a proper company then its details should be on the Companies House website with a registered address.

You could also read that as the authors being based in the UK, not the publisher.

 

You still haven't told us what your problem is with the publisher or Mr Salgado-Reyes, who seems to be a private investigator from what I've seen. Going back a few posts, someone suggested you tackle the problem through Amazon rather than pursuing someone around London or the UK. Is there a reason why you can't involve Amazon?

 

ETA: Do you know for sure that Salgado-Reyes is the owner of the publisher? I haven't seen that online.

Where is it stated please? And could you also answer my question about going through Amazon? Last time I had a problem with a company that wasn't based in the UK, it was very easy to get a refund via Amazon. I wouldn't have stood a chance on my own.

I think the amount of your claim is very relevant and also the reason. But if you're determined to play secret squirrel you're likely to find less help. 

 

Why would I spend my time and paid for subscription to a website to help you look when I don't even know why?

But nobody else has asked about this company so far. Would you like me to add the name of the publisher and the presumed owner to your thread title so that anyone with the same problem, whatever yours is, can see the thread and hopefully come to the forum?

 

To add to what Bazza and others have said, we're a self-help forum, meaning that we point people in the right direction to help themselves, which we're trying to do with you. For me, that doesn't mean paying for their research or doing all the work for them. Maybe I'm too tough.

Probably by chance, but as we know hardly anything about the website because you won't tell us, it's difficult to say.

 

If you've been in touch with Salgado-Reyes or his company about whatever you're unhappy about, that might possibly have something to do with it.

Sadly, I agree with you, MiE. Normally a thread like this would start with the OP sharing what they know so far about the company or individual causing them issues and telling us what's happened.

 

Most people in a similar situation want to broadcast the name/s far and wide, to get publicity for the problems and let other people know. It seems that altruism is expected of caggers, while @todaydoesn't seem to want to help others, unless I've misunderstood so far.

 

In terms of free information. @today, if you don't think it's worth paying a professional to find who you're looking, although we recommended that, you can view the electoral roll in person at council offices. It may not include people who have asked for their details to be kept confidential, which I do. It also, of course, involves knowing where someone lives.

 

Please don't think people here are going to do the searching for you, it's not what we do.

 

Guildford council has information on electoral registers and on other ways to look, I don't know a couple of them.
