I recently separated from my wife and moved out on January 15th. She stayed behind at the old address and have the children with her 5 days a week. The tenancy agreement there has both our names on it. I want to give notice now and remove myself from the tenancy. My worry is that if I give notice, this would end the current tenancy and the landlord can ask her to move out (which he has been asking for since July 2020 because he wants to sell the house).

 

Q: How much notice would he be required to give her if this was to happen?

 

Q: Since I am giving notice now, can I ask the landlord to offset the month's rent from the deposit? (The deposit for the property was taken by landlord's representative back in Jan 2017 when I first moved in...£750 which was not put into any DPS scheme, but I think I have a receipt for the payment somewhere)

 

Q: If I was to not pay rent for this month at the old address, what is the likelihood of the landlord taking me to court for this? (The rent due is £650.)
