I have a fight on my hands getting MBNA to send me my information after I sent them an SAR.

I've spent about an hour looking for this info, but I can't find anything, and I'm sure I've seen it somewhere before:rolleyes:

Can someone please confirm for me whether the 40 days to comply is 40 working days, or 40 calendar days.

I know it starts from when the recieve a properly paid for request (another stumbling block in this case, see my thread in MBNA), but I don't know how long to tell them they have left in my reply to their stalling letter.

As BW says it's calendar days from when they recieved a properly completed - and paid up - request.

MBNA are a nightmare, they are staggeringly incompetant. Also, they will try to fob you off with incomplete information. If you have charges older than 6 years don't let them con you ionto thinkning they aren't obliged to provide details of them.

The DPA has no expiry date. If they have the information, they have to provide it. Thanks to the ICO (which has more spine than the OFT) even if they've archived their paper files to fiche, they have to reproduce them for you.
