Help needed!!! Default with Egg

Hi all,

 

just a quick background I had an Egg Card from the year 2000 and they defaulted me in 2003. I had fully settled the account by 2004, but from thinking back I was only ever told over the phone that they had defaulted me and I never received a letter through. So after looking through various websites I decided to send a letter to Egg asking them to supply me with a true and certified copy of the default as I had no recollection of receiving one. I sent this letter on the 27th October and requested the data to be provided to me within 28 days. It's now the 28th November and I have not heard a whisper from Egg.

 

With the letter I sent a postal order for £1 which is the statutory fee and as I understand that under s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) they are obliged to supply me with this data?

 

As I hadn't heard anything I rung them today and a chap at Egg said they don't have to legally supply a copy of the default and he could only read out why I had received one.

 

Is this true?? I need to know what is the next line of action??!!

this is not the case

 

They DO have to supply you with a true signed copy of the default notice they claim to have issued you

 

Egg are absolute **** when it comes to this kind of thing - take a look at my own thread re: trying to get the removal of a default where they havent issued a default notice - they believe they are a law unto themselves and can conduct their business beyond the law

 

I am just building up the funds and right timing to take them to court over it

 

I would advise contacting the Information Commisioner about this - that is what I intend to do (as an interim to court) - and if enough of us do this someone might sit up and take notice

 

As an aside, Egg are losing money hand over fist at the moment, believe the last years lossses were around £70m
