I had a CCJ from over 10 years ago paid off,

it was at my parents address,

a charge was put on the house,

but had been paid off,

 

my parents have since sold the house,

but now we need to find the information about the ccj as it still shows on the house ,

 

I can not find any information about the ccj as it was paid off years ago,

 

any help please

urm..you are not making much legal sense here.

 

you, unless you were a joint owner (on the deeds), couldn't of had a charge put against your name on your parents home.

 

a CCJ doesn't show against an address

it's against person on their sole credit file.

It was put in my mums name as she was a guarantor for the flat, and I’m told a charge was put on house, the solicitors are asking for the ccj reference but we have nothing

so in effect nothing to do with you as such ??

you didn't get a CCJ at all

its was against your mum?

 

you mum acted as a guarantor for a flat,

you failed to pay 'whatever'

it then fell to the guarantor to pay 'whatever'

she didn't..

and for whatever reason failed to also defend the resultant court claim and the claimant got a CCJ against HER? or was it granted by default?

 

then also went for and successfully got a charging order against the old family home

 

the charge was obv dealt with (or not needed to be as it was only a restriction k on a joint home with your dad) upon sale.

 

so who's name is on the CCJ

and why is it causing a problem to what?

The ccj was defaulted on to the family home, but was paid off.

 

all I know is that the solicitors are asking for information about the ccj as I presume the charge is not off the house, I’m just wondering if there is any way of getting any information in regards to the old ccj

a ccj can't be 'defaulted' against any home

it's against a PERSON who once was resident there when the claimant got the default judgement 

 

the CCJ can't and doesn't ever show against an address

it shows against a PERSON on their credit file and in court records for 6yrs.

 

the charge and the CCJ are two sep things

your presumption is wrong...the charge off which house? the one your mum and dad had?

you said the home was sold

the charge can't now exist ...the person who's name it was against no longer lives there.

 

who's solicitors are asking for this info?

 

is it in a letter you have please

The Land Registry should have details of the judgment claimant marked on the deeds of the property.....who was making payments towards the judgment...have they no reference of who they made payment to?

I’m not 100% sure, sorry I should have said the house is in process of selling, 

 

i just got call to say they needed the reference to the ccj my parents paid it off but none of us can find the details as it was years ago, I’ll try land registers to get the details 

 

I got the reference number charge is still showing, but called the court and they can’t find it, (I presume, with being over 6 years it’s gone) but it is paid off, but yet the charge is still there?

And the name of the judgment claimant named on your deeds? Get that and tell your conveyancer to tell them to remove it.
