Hi Hornsey - can you pls elaborate? I am not sure I understand your point. This debt is a mortgage debt (as opposed to personal loan) and jurisdiction clause does not have the non exclusive wording. It is also secured against an an apartment in abu dhabi. Not sure how can they bring the claim in front of a uk court.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

No, you not paying is not a dispute.

 

if for example, they increased the interest rate on the loan and you disputed the reasons for this increase, that would be a dispute.

 

it is an argument about the mortgage companies running of your loan and the terms/conditions that apply.

 

Either you share full information about the situation on a public forum like this, in the hope of getting some information which might assist you. Or you seek Solicitors that specialise in foreign debts. Previous reports by people seeking such Solicitors advise that most work for creditors chasing debts, so won't help and those who are available want to charge a large amount upfront. One person was quoted £5k by a Solicitors just to take a look at the case.

 

You could write to the Solicitors chasing this debt, advising of issues in the UAE, their client should have advised them of. And you require them to supply copies of documents in English including  a copy of the original finance document with associated terms/conditions, copies of any notices of default, copies of important documents that relate to reporting of any debt under UAE law, copies of all statements of account and copies of your data records held by the UAE Bank. Send it by recorded delivery.
