Southampton Solent University/Student Finance - Loan overpayment. threatening court/bailiffs

Hi,

 

My son started a University course in September 2015 but left after a month due to health issues (both physically/mentally) we let the Uni and Student Finance know immediately.

 

Student Finance are constantly in contact regarding an overpayment of just over £300 and refuse to back off and keep both phoning and sending letters, my son is claiming PIP but nothing else, he is on medication and a doctors letter has been sent to SF to explain the situation.

 

They have suggested that I help pay his overpayment but im a carer for his younger brother and don't work.

 

Ive been told that they will proceed to court and bailiffs and am worried about this.

 

What is the best thing for us to do as he doesnt have any money at the moment?

Please will you tell us which University this is. I think that potential students – and their parents need to know which of these apparently social institutions are becoming so hard-nosed as to cause problems for vulnerable people.

 

You say that they have suggested that you should help with it. Have they put this in writing? It is quite frankly scandalous.

 

If they take it to court, you don't need to worry about bailiffs. Your son would simply be able to present his financial situation to the court and asked for reasonable instalments to be ordered.

 

The best thing that he could do now would be to start paying an affordable amount. This would take the wind out of their sails and also start reducing the sum owed so that it became less interesting for them to take any action but also so that you could demonstrate to a court that you are dealing with it correctly – in case the University really decided to do something stupid.

 

How much could he afford each month? Which University is it?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Its Southampton Solent University but its Student Finance that is putting the pressure on him with the constant letters and phone calls.

Unfortunately it was only in a phone calls that they suggested that I help him out and I quickly told them that it was never going to happen.

 

Ive been told that they will put an attachment onto his PIP and regain the money that way.
