Getting hassled by Erudio again for a statute barred sl. I informed the SLC that this loan was statute barred.

 

 

Do I send the template statute barred to Erudio or is it safe to just ignore them?

there is no correct proceeding for sending the SB letter.

you save that for if they do court...

Loans taken out first year of University 97 and second year 98 under the old style.

 

Had to leave due to disability which I still have.

 

Had confirmation that the 97 loan was statute barred from SLC and Link after a lot of hassle.

 

I wrote at the time to the SLC stating that the 98 loan was SB. However, they did not address that.

 

Have now received a Demand in Full from Erudio Student loans for the 98 loan.

 

"As a result of your loan reaching maturity and there is still an outstanding balance

you are currently in breach in accordance with condition 9 of your agreement(s) (for loans taken our [their spelling error] before 31st December 1997) and Condition 5.2 (for loans taken our on or after 1st January 1998), failure to remedy this situation may result in legal action"

 

Can anyone advise me on the best thing to do?

Write to Erudio for a full copy of the exact terms and conditions of the 98 loan.

It just needs to be a basic letter.

 

 

Further to your letter date xxx, please supply me with a full copy of the exact terms and conditions of the 1998 loan that i had agreed to and not a generic partial copy.

 

Are there any reasons why the loan may be written off due to your disability ?

Sometimes with student loans they include terms which allow a debt write off, if you meet a certain criteria.

We could do with some help from you.

I suggest you go back to post 1 and read the whole thing.

 

 

the debt is statute barred

and was when you wrote to SLC long ago.

 

 

if you are going to send anything

simply send the statute barred letter

that is already in this thread

then IGNORE THEM

don't enter into further letter tennis

as you appear to have done with LInk/Thesis

Thanks for your input. Whilst my health has deteriorated and I should be allowed this to be written off due to disability, the debt is statute barred and so I will re-assert this first.

I can not find the link to the Statute Barred template I originally use. I have been to the "library" and searched the forums. I wonder could you direct me to the right link?

The statue barred letter is in the debt collection section of the library
