i have a smile account, as yet i haven't totalled the charges i've paid over the years.

i am self employed, always have cashflow problems, and have had a couple of letters from smile saying that as i do not pay in the agreed £1000 per month i am not fulfilling contract ( words to the effect) would that jeopardise any claim i made?

I am pretty sure this has no bearing on your claim whatsoever.

 

Also,

 

I'm not sure the term is valid as this is only a recent development, if you have access to your original t & c's I don't think you would have agreed to it. I know that i didn't in 2004.

Correct - it makes no difference to the charges, which are disproportionate to the costs incurred.

Do you guys know the status of Self Employed regarding back charges refunds? Im told (by my business bank of course) that all those refunds relate to consumer and not self employed / sole trader, although I beg to differ as its still a personal individual customer they have dealt with! Thanks.
