south west trains - in 1st Class carriage with a valid standard oyster card

Hi,

 

I today was caught travelling in first class carriage on south west trains from waterloo by one of the revenue inspection officers.

 

 

I had a valid season ticket oyster card ticket for the train

but was not valid to be in first class frustrating as only reason i was in there was due to the overcrowding in standard class.

 

 

in my annoyance at the ticket officer i gave a fake name and address which was pretty stupid

as think he will have my oyster card number down

so will be able to track me down irregardless.

 

I would much appreciate any of your help on any of the three questions below.

 

1) Does anyone know about how to go about changing their information on a fine? e.g how to contact them?

 

2) I am concerned that in my frustration has putting the wrong name down

has might lead them to prosecute has anyone else been in the same situation?

 

3) Does anyone know what the fine will be for being in a first class zone without a first class ticker

even if you have a valid standard class ticket?

Hello and welcome to CAG.

 

There isn't really much point in contacting them at the moment, because you don't have the reference number for your case. Are you able to access mail sent to the address you gave the inspector?

 

I don't think having a standard class ticket will make much difference because you hadn't paid the right fare. Unless the guard announces that people can use first class, unfortunately you have to put up with the crush.

If they accepted the details you supplied, which it sounds like they did, I'd pay up and say no more.

As long as you pay the notice, you'll hear nothing further

(bearing in mind your details will more than likely be correctly logged on your Oyster record).

 

 

You could also appeal, but to be fair I think quite frankly, you'd be cheeky to even consider doing so.

 

If you were prosecuted, it would more than likely be under

s5(3)a and c of the Regulation of Railways Act 1889 (intent to avoid payment and supplying an incorrect name/address)

which per offence would average out at 400GBP plus all incurred costs etc.

Just pay the notice.

My mistake....for some reason I could have sworn he said he was given a PF.
