Hi,

 

First post on here so apologies if this has been done to death.

 

I did a quick Google search for the comments in my Title and it directed it to me to a thread on here. But like every case mine I'm guessing is slightly different and was just hoping someone could offer me some guidance as I'm getting more and more confused.]

 

My chain of events are roughly:

 

April 2015 - Overstay in Morrisons Car Park - Total Duration 2hrs. 59 mins

Series of letters, first to my old address (my fault, had not updated) then to my current address.

Aug/Sept 2015 - Threat of County Court in Northampton with a certain timeframe to respond

Sep 2015 - Responded with my defence

April 4 2016 (today) received a letter dated **February 2nd 2016** stating "Notice to Proceed"

 

But that's pretty much it, there is legal argument and it touches on what I said in my defence 7 months ago. There is no timescale to respond and even if there was, the letter is dated over 2 months ago and I've not had anything since or heard from them or the Court again?

 

Also, I'm pretty sure it said when I responded to the initial County Court Claim that they had to reply within a certain timescale and if they didn't there'd be no case to answer?

 

Seeing as I'd not heard from them in all this time I thought that timescale had long elapsed and I'd hear no more?

 

I'd be very grateful to hear some opinion on this if possible and thanks in advance.

and will remain that way

till PE pay the fee to unpark it?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

So have I checked the status?

No.... today was the first I'd heard on the matter for 7 months.

I also haven't got the password etc to log in to MCOL.

Should I contact the Court and ask and if so what am I asking about?

 

I had thought though that if they didn't respond to me after I'd submitted my defence

within a certain time that this would be dropped.

Did I get that wrong?

Did you receive a proper N1 form from the county court (normally Northampton bulk centre)

or was this a pile of waffle from PE?

 

 

If a proper form there will be a reference number something like 2QB11111

and you can then phone the court (any court) and ask about the progress of this claim.

 

If it was real did you respond to the court as required or just send a letter to PE.

 

from what you say it was just a threatogram from PE ( or some random dca)

so no harm done so far.

 

 

Let us know who it is from and what it says (not an interpretation) and we will advise what to say and to whom.

I've just found some of the old forms from September.

I think it's from the Court and not P E.

 

 

The forms are labelled at the bottom left N9A (SDT) Form of Admission.

 

N9SDT Response Pack

 

N9B (SDT) Defence and Counterclaim

 

On the Response Pack it says in the top corner

"if you want to defend all or part of this claim or request additional time to prepare your defence

you can respond on line by logging on to money claim.com etc etc.

This is what I did back then.

 

I've got the claim number now so will attempt to find out what the status of the claim is.

Hi,

 

Yes I attempted to do that but the password (or Claim number) is now showing as incorrect.

 

I've definitely entered in correctly so I don't know what the error can be? Maybe something to do with the fact it's been so long?

ring up the court and once you have navigated their dreadful options menu ask someone to check it for you.

 

It is not unknown for parking co's to send out prevuious or ficticious claim forms to get you to pay up and save them the cost of going to court and trousering the supposed costs of doing so.

 

 

Out and out fraud but no-one has been arrested for it.
