Hi I've had a text today of EE saying this:

 

from 30 March 2016 your monthly price plan will increase by 1.3% in line with the most recently published RPI (Retail Price Index), as per your terms. For example, a £31.32 price plan will increase by £0.40 a month. For more info and to calculate your new monthly plan cost, visit http://discover.ee.co.uk/ee/FV9E8o

 

My question is am I able to cancel my contract (which I only have 6 months left on)with no penaltys,due to this price rise and from what I've read ofcom say as long as you've took the contract out after the 23rd Jan 2014 I can cancel. have I read it right? The reason I want out of the contract is simply to reduce my outgoings

Yes, I had one of those as well.

 

I have just had a look at the contract and it does say that there will be an annual price increase and it will take place in March of each year. There also appears to be an ambiguous statement - that if the change is of material detriment - which it appears to be so. Then you can cancel without charge as long as you do it before the change takes place.

 

So you might need to make contact with them immediately.

My letter states early cancellation charges will apply so if there's a way out without paying I'd like to know. Interestingly they're not likely to charge odd pennies when signing up, and not likely hike prices so chances are new contracts after March will be at old price

Mobile contracts and RPI

 

For contracts taken out before 23 January 2014, there are no clear rules in place that allow you to cancel because of price hikes during your contract.

 

Your mobile phone provider may be able to hike the price of your fixed contract by the rate of RPI.

 

However, for fixed contracts entered into after 23 January 2014, you are able to exit without penalty if your provider does choose to hike up its prices, unless you were told at the point of sale that the price would definitely be increasing.

What are your thoughts on this ?

 

In what way, from what I am understanding, if you do not wish to continue with the contract then you should be able to end it without any exit fee as long as you do it before the new charge comes in.

not too much of an issue i get 30% off my monthly through work

 

still annoying tho

Unless:

a) the increase is by RPI or less only, and

b) the fact there is a yearly increase was mentioned at point of sale and is in the contract terms.

 

You can bet (if you ask to leave "early") that they will state both a) and b) apply, restricting your ability to leave early without penalty.
