as previously said, should it come to court, the most likely outcome would be a suspended return of goods order or a time order

Send another letter headed Formal Complaint setting out your offer, and require that they treat you fairly under the FCA guidance of PRIN, principle 6

together with a general complaint about their unhelpful attitude. Send by signed for delivery

They have 8 weeks to respond to a formal complaint, in the meantime continue to pay the token payment that you can afford

You can also read up on time orders should you decide to take that route as advised in the link above

  • 3 weeks later...

Hi, back again.

I have had no reply to my offer to pay a smaller amount

I have received a default notice and they are asking me to give the car back by the 25th February,

with the keys, log book and registration documents.

I am scared to ring them as they are not helping me at all

Thank you for any help

I thought they defaulted you ages ago you said.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi,

Yes they sent a default notice.

But they haven't replied to my letters or emails

And then sent the letter to say they eant me to give them the car.

I'm going to ring them tomorrow and ask to speak to a manager and see whst they say when i tell them to take me to court.
