I will do mate, will take me a few days to get everything rounded up tho

 

I lost my job last December and have been living off my current cards since then pretty much.

 

i also have approx eight CC defaults from ten plus years ago which im getting lots of hassle from all of a sudden.

 

I defaulted on these card in 2008 but had been paying a token £1 amount on each up till 2014 so non of them are statute barred sadly.

 

My thoughts are to simply draw a line under it all and start fresh as the stress is becoming a little too much bare.

Hi Folks

 

Just following my previous post with more correspondence from Restons which i received yesterday.

It seems they are planning on going back to court but are now offering a reduced settlement amount.

 

I'd appreciate some word of wisdom as to whether or not i need to respond to this or not?

Im presuming not but thought i better check as they do mention court intervention

HI folks

 

Im back once more regarding this business.

 

I received a letter pack in the post this week and Restons are attempting to have my stay lifted without a hearing.

 

Not sure what to do so any info is much appreciated.

 

This is for a current account overdraft and they've sent a number of things including:

 

two witness statements

 

a cabot letter dated 2012 telling me they have bought the debt but sent to an address i hadn't lived at for four years

 

A bank of scotland letter dated 2012 telling me that they have sold the account to cabot but again sent to an address i hadn't lived at since 2008

 

Statements of the account from 2006-2011

 

Some statement from Marlin showing monthly £1 payments over a period of 2012-2016

 

A letter before action from Restons

 

A document titled "Request for judgement and reply to admission" This has legal fee's included which add a further £800 to the claim

 

All in all im not to fused as i own nothing and im in dire straights financially with both current and historical debts as well as suffering mental health issues.

 

Even so, i'd still prefer not to have to deal with this as i was just beginning to have a period of good health and would like it tio continue

 

I've attached some images of a few doc's as i thought they may help with any advice

Yes there is a N244 included, i've attached the first page to my last message.

I'll get the lot scanned tomorrow and uploaded, I've still got my defence to write up for another case coming up it looks like next week is already taken care of time wise!

Ok, that took some figuring out but it's now uploaded and redacted in full.

 

Two thing that struck me when going through it was the two letters sent to my old address which was vacated four years previously

 

the balance on my current account statements.

 

The final page states £24k was paid into the account

£22k paid out

but that im £2k overdrawn.

 

Am i misunderstanding something regarding this?

Will do mate, it's something i've been ignoring but im simply fed up of all the letters. I have historical debts such as this and Cabot own approx five of them. I also have recent defaults which will need dealing with.

 

Fundamentally i've been juggling back and forth for years and im worn out with it all. my health has suffered and i want to draw a line under it all.

 

I own nothing and im now on long term ESA so the time is right

 

I'll start a new thread as you suggest

am not up with your thread

but, don't let these planks affect your health.

maybe bankruptcy is the best way. no property/assets. get rid. start again, be healthy.

how much is your total debt.

yes, can include an unsecured claim debt/judgment.

get as much advice as you can.

Just gone to start a new thread on the BK forum as you advise but it wont allow me for some reason, i caan type my post but as soon as i attempt to title the thread is closes itself and reverts back to the main forum

 

Im presuming this is a site issue, yes?

Thanks for chiming in Ford, my total debts both current and historical come to 77k and considering i've not worked due to illness for a year, bankruptcy makes sense.

i just need to find the funds to do it ironically enough

 

I’ve seen people take credit out and inc it their bankruptcy before
