Hi

 

I hope you can help.

 

 

I have been told a citation was delivered to my old address in Scotland

( i now live in england and have done for a few months now) for an old loan from 2007 from Bank of Scotland £15k.

 

 

The documents have been posted to me.

I cannot recall what it was.

 

 

I also states in the writ that a payment was made in March 2014 which I could not have done.

I suspect this maybe statute barred but have no statements or anything to determin this.

The return date is 9th November.

shall i just fill in form 07 and detail new address?

 

I am about to send a CCA to Cabot who apparently had debt assigned in November 2014.

Optima legal in Glasgow are the solicitors for Cabot.

 

My husband is terminally ill and although happy to defend cannot attend court to defend this in person and cannot afford solicitor.

 

 

Any help on best way to handle this appreciated.

Yes you need to inform both Cabot and Optima of new address and of the health situation of your husband. Also send a CCA request to Cabot. I would also query the last date a payment was made and for full details of the payment e.g amount, method, debit/credit card or bank details used.

as you mention form 07?

 

 

are you now perm in England never to return?

Thanks for the advice. I have sent CCA today to Cabot. I will wait until 5th November to send form 07 intention to defend as i understand it is best to leave it to last minute. I have also sent a letter to Optima enclosing copy CCA request plus query regarding payment. Lets see what happens.

no good trusting the fleecers that are taking you to court

to provide evidence of the payment is real

 

 

barring that phantom payment

and the fact that cabot [if you read in this forum]

issue Scottish claims like water

then lose

 

 

would there have been any regular payments made

and on what date do you think they really stopped?
