Hey Guys

 

I've been dealing with Jacobs more than once, a few months ago I cleared a debt of around £800 with them - this was for a previous address in my name. I was paying £50 per week each week and I finally had to clear around £350 up front for one missed payment. I did sign paperwork on this address and I told them some of the items I had but never let them in - to my knowledge this was still valid for them.

 

I now have a separate account with them, completely different address and town with my ex-fiance's name also on the debt. I've mentioned this to her (as she's moved) but she's unwilling to help and I realise that Jacobs wouldn't care as long as they can get to me.

 

Today I received the first hand delivered letter "24 Hour Removal" demanding I pay just short of £3,000 up front which I do not have. I am thinking that because this is a separate account they would still need to do inventory and have paperwork signed to be able to forcefully enter this home.

 

When I cleared the previous debt, the agent told me he would call me again to arrange a £25 per week repayment on the new house (but to me it was implied he'd need to visit my home to do this) he never called back.

 

I would like to start making regular payments, but I'm not sure where I stand - I also realise I can do weekly payments to the council after reading a thread here which is something I want to set up as I struggle to pay that when I'm always paying these guys - it just never ends otherwise.

 

Any advice would be appreciated

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Associated lo? I'm sorry not sure what that is.

 

The letter I received was a standard jacobs letter with the big red text on it, I've received them in the past, but never seems to be anything official except scare tactics.

 

I can't post images yet but if you search "Jacobs 24 hour letter debt" in google images, it's similar to the first 3 results.

Stephen, the amount of this new debt is a lot. Does it relate to one Liability Order ( I assume not). The debt is a joint one and unfortunately, the local authority (and their agent, Jacobs) can elect to pursue either of you or both of you.

 

There is actually no legal obligation as such on you to allow a bailiff into your home and being really honest here...given the amount of the debt (£3,000) I would be very surprised indeed that a Controlled Goods Agreement (previously called a Walking Possesion) would be of any use given that you would probaly not have sufficient non exempt items worth levying upon. The previous 'walking possesion' or controlled goods agreement (depending on the date) would only be applicable to the previous debt. A new agreement would be required for this latest account.

 

I would suggest that you contact Jacobs as a matter of urgency to outline a payment proposal. If you have a car, then you need to be aware that it is at risk of being taken into control.

Thank you so much this is exactly what I wanted to know, I understand I am more than likely going to need to pay this - as I was paying previous things and trying to get all my bad decisions sorted from when I was younger cleared out, this particular debt grew. I was working with Jacobs prior like I said and was aware of the account, but they wanted to clear the initial one first.

 

I've no problem making a payment plan, it's quite a hefty figure and the previous agent did propose £25 a week but I can do more if need be. I just don't want someone breaking into my home tomorrow when I'm at work before I've had a real chance to arrange everything. And besides you're right about sufficient non-exempt items, the ex took everything pretty much! I think the only real thing of value is my computer which I use for work purposes.

I was working with Jacobs prior like I said and was aware of the account, but they wanted to clear the initial one first.

The bailiff has no legal right to force entry into your home. Please let me assure you of this. In the first instance he would need to have a signed Controlled Goods Agreement....he does not have one. Secondly, you would need to have defaulted on the agreement under the Agreement. You have not done so....that previous agreement was only in respect of the previous Liability Order that has now been settled.

Thank you for your clarity, this is what was concerning me. I'm unable to top up my mobile until tomorrow so I was becoming concerned as I wouldn't be able to call anybody to settle it.

 

You've lifted a huge weight from my shoulders, I will top up tomorrow and sort out regular payments (to both the bailiff and the council)

it might pay you to contact the council concerned and :

You need to speak to someone at the Council and ask the following questions:

1 - how many Liability Orders they have against you

2 - the dates they were obtained

3 - the addresses they were for

4 - the period of time each covers

5 - how much each one was for

6 - how much is still outstanding

7 - the dates they were passed on for enforcement
