I have received a small claims action in the post.

It is a warrant to serve.

The pursuer is Cabot Financial (Uk) ltd.

The pursuers solicitor is Optima Legal Glasgow.

 

The debt is listed as. Halifax Credit card entered into on 28th May 1996.

The papers claim that I made a payment on 29th September 2011.

 

I have not acknowledged this debt and did not make the alleged payment in 2011.

The amount sought is £2,942.92.

I am very worried about this as I am self employed on a very low income and struggling to make ends meet as it is.

How do I argue that this debt is so old that it should be time barred and that I did not make the payment claimed?

I cannot pay for a solicitor so I will need to represent myself.

I must respond to the court papers by 30th September 2015.

Any advice would be gratefully received.

easily done and you don't need a sols at all

 

is this a form 1a small claim?

just cabot issuing speculative claims in Scotland as they quite often do

 

go ring Halifax see if they have any details on that payment.

 

pers I'd file its statute barred, bugger off cabot.

 

lets get the info first

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
