Welcome Finance/Cabot Claim Form issued

Can someone help/advise me please?

 

 

I am feeling stressed at the moment so will post the outline of what has happened. I know that you might need further information to possibly try and help, so please tell me what information I need to post and I will try and do that.

 

Basicallly, I took a loan out on in April 2007 and continued making payments on it. Some time later, I stopped making payments and was relying on Payday Loans. I was making payments to a doorstep collector and when I found out that I did not have to do that, I basically stopped.

 

I have now received a Claim Form from the Northampton County Court stating Mortimer Clarke Solicitors have referred the matter to court.

 

When I was checking the "penalty" charges that Welcome had levied on my account, I questioned these and did not receive a satisfactory response from them. I then referred the matter to the Ombudsman who stated that they could not see these charges added on and I was advised to pay Welcome.

 

I have default notices where Welcome have added approximately £500 in charges and I do not know the amount of interest this has generated. The "accounts" Welcome have sent to me in the past have shown an "adjustment", this adjustment is basically the total of what they are now claiming I owe them.

 

I have read the other threads on here and know that I have to acknowledge service of the claim form.

 

Can someone advise/tell me what else I can do please?

The Claimant is Cabot Financial (UK) Limited

Date of Issue: 3 August 2015

 

The POC are:

By an agreement between Welcome Finance (WLCF) & the defendant on or around 25/04/2007 ("the agreement") WLCF agreed to loan the defendant monies. The defendant did not pay the instalments as they fell due and the agreement was terminated. The agreement was assigned to the claimant. The claimant therefore claims £1565.69.

 

It was a loan that I took out on the 25 April 2007.

 

I do not recall receiving the notice of assignment.

 

I last made a payment approximately 2 years ago.

 

I did not communicate my financial issues to the original creditor.

 

I was making payments to a doorstep collector and unfortunately, I was relying on payday loan companies.

So you have acknowledged the claim on mcol and ticked defend all?

 

It is very important that you confirm this

 

Next step ASAP by signed for delivery CCA request to the claimant under s77,

 

CPR 31.14 request to the claimants solicitors for docs mentioned in the POC

 

Also

 

Although it may not arrive in time, send a SAR to Welcome as it may be of future use

 

Most importantly make a note of your defence due date, do not miss this

under any circumstances

No, sorry, I have not done that yet - I registered earlier on the MCOL website and it was asking me to submit my defence in 122 words or less. I then stopped as I did not know what to put in there.

I managed to just acknowledge the claim.

 

I appreciate the help given to me so far.

 

I will send the CCA request tomorrow and the CPR request to the solicitors
