Hello, I'm disabled and live with my mum, mum has dementia and is currently in a nursing home for a while. Now I have asked the council (Havering) about staying when mum goes, my dad died in 1969 and I'm not sure whether he was the tenant and mum succeeded him or it was a joint tenancy or even if mum was the tenant, when dad died we where under a different council (Tower Hamlets). Now I don't know where I stand and it's very worrying. It is a 2 bedroom maisonette but as I am on dialysis I was hoping that I could have dialysis at home in the 2nd bedroom, along with the dialysis I have also had a triple heart bypass with causes low BP which makes me dizzy and unstable, on crutches. There are other problems which I can expand on if necessary. Thanks

If you have lived with your parents all of that time then you will inherit the tenancy. If you live on benefits then there will be a reduction in the HB part forunder occupying the property. Swapping for something more suitable may well earn you a bounty as many councils have schemes where tenants are paid to give up larger properties if it is exchanges through their scheme

My next door neighbour lived with his mother till she died. The shire council made him move out of the two bedroom house and rehoused him.

The council stated that a single person cannot live in a property of more than one bedroom due to housing waiting lists and suitable accommodation

He inherited the tenancy with the council, just not at his late mother property

He had no choice in the matter

This was this particular council, yours might well have a bounty scheme to move

your starting point is to gather more information, such as

  1. type of tenancy
  2. date tenancy began
  3. is the council the landlord or is it a housing association
  4. has the tenancy previously been succeeded to or assigned (such as to mutual exchange)
  5. how long have you lived in the property

A few of the London Borough Councils, though I am unsure if Tower Hamlets do the opposite of a Bounty scheme, they offer people who need rehousing homes in Wolverhampton, Birmingham, Manchester, and some of those Essex seaside towns C5 & C4 are obsessed with filming in, that look more like Beirut, but even tougher, and messier. And if they refuse to move to the offered places, despite them being a very long way from their family and friends, and giving up a job, plenty of single parents working part time had to give up their jobs to move to places like Wolves, and of course the struggle of living well away from your social/support network of family and friends, but if they refuse, they are classed as "intentionally homeless"
