Hello all,Basically my friend had a fine from Nottingham City Council for parking in a disabled spot in Nottingham town.This has been left as they didnt receive any correspondence about the issue.They didnt receive any paperwork as at the time they were living away from home due to extremely stressful circumstances, namely their child was in a mental health unit in Nottingham so they stayed in Nottingham to be with said child.Needless to say yesterday they received a visit from an agent of Bristol and Sutor, its been through court etc and they want hundreds of pounds.They have told the Bailiff to go away, and have let them and the Council know they are vulnerable as the parent is single and all children in the property are disabled with either learning or mental health disabilities.They disagree that they have to pay any money for the fine in the first place as they are a blue badge holder and were displaying at the time.Basically what can they do to get the council to take back the fine so they can sort it out properly without all this stress and upset it is causing the kids?The Bailiff says he wont send it back to the council as all he can see is pound signs, he's offered to set up a payment plan but the parent says no way as I dont owe anything anyway !I have read somewhere you can ask for an" out of time late statutory declaration"?any help please !!

Yes as the person in question was staying in nottingham not at their registered vehicle address.

their child was in for about four months.

they aren't trying to get out of anything they are obliged to but given the circumstances don't need the hassle or upset.

No ticket on the vehicle when the "offence was committed"? All subsequent notifications would go to the address where the vehicle was registered at the time of the offence. There would be quite a few of these - possibly 5 or 6 & spread out over a longer period than 4 months. If the post was mounting up how did other bills get paid.

 

As for being potentially vulnerable they would have to write to both Council & Bailiffs & also enclose proof of same.

No ticket as it was camera, Proof needs to be scanned and sent to both that's sorted. Post and bills piling up yes they have and are being worked through, bills were last thing on their mind kind of take a back seat in situations like they were in. any advice on actually getting things back to the council to sort out properly.

I think the only way forward is to try appealing to the Council's better nature but think it will be an uphill struggle. I can't see an Out of Time working either. It may be prudent for them to contact their local Councillor(s) and see if they will take it up on their behalf. I referred to their potentially vulnerable issue previously and they should try this also.
