Vt'd car, over 50% mark, northridge want paying for minor 'damage'

I vt'd my car last month,

 

 

it's with northridge and I was over halfway through so thought all was good.

 

 

When I notified them they sent a letter saying when G3 collect the car and examine it

if I was to pay any damages then I should do so within ten days.

 

 

It then states if I want to repair the damage myself then it would result in a delay in terminating my agreement.

This was a month ago.

 

 

I have today received a letter saying that the car had been sold at public auction and that I owe them 400 quid.

 

 

They have included a report and pictures of damage which is a couple of chips, a scratch on the rear and small crack, and a scuff at the front.

The cars 6 years old now.

 

 

They have said its been sold so I am wondering why I haven't been offered the chance to have it repaired myself?

What will I say when I phone them?

 

'You never told me what damage was there and I wasn't told about this before auction so I couldn't exactly repair it myself

and now I am being billed, that's not correct'

Any help is appreciated and sorry for the vague post this is from an iPhone sorry.

that kind of damage is viewed as reasonable wear and tear

 

 

they are pulling your ...

 

 

you've paid over 50% . tough luck to them.

 

 

did you not take lots of photo's before you VT'd it?

I never took pictures, I am worried about credit rating being affected as I am 22 and don't it being affected by something like that. Should I even bother getting in touch with them?

59 plate bought in July 2012 and vt'd may 2015

 

Have they any right to bill me having auctioned the car without me knowing whether it was fixed or not? And not giving me the chance to fix it myself?

it was second hand then.

 

 

ask them for the pictures they took before it was sold to you.

do you have any documented evidence of the cars condition on your purchase?

 

it merely has to be in reasonable condition (average condition ) for its year

(4)If the debtor has contravened an obligation to take reasonable care of the goods or land, the amount arrived at under subsection (1) shall be increased by the sum required to recompense the creditor for that contravention, and subsection (2) shall have effect accordingly.

 

finance cos hate vts and this gives them an opportunity to try and make up for their 50%,

 

and get some money from you by charging you for damage that would not be considered “reasonable care”

 

Usually this involves threatening letters, and large invoices for minor scratches

 

stand your ground

Hi, I had the same problem when I VT'd a jeep.

It didn't make as much as they expected at the auction and wanted me to pay the shortfall.

 

They must of given you a collection sheet with all the condition details of the car.

 

With mine they said they had a 'second inspection' done and they had found a load more damage.

 

When I complained and was going to escalate to the FOS, they as a gesture of goodwill wrote of the balance.

 

Dont accept their findings, it is you right.
