      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

LOL, you lot are getting more bizarre by the minute.......I think its the waiting.....we've all gone mad!

Hi All,

Being poor is certainly NOT fun, but also being rich is not a bed of roses and certainly does not guarantee happiness (so I'm told) :D

I am ready to file MCOL against HSBC. The only thing I am concerned about is do you have to physically appear in a court if the bank don't settle the claim, or is it all done on your behalf. This has probably been answered elsewhere but there is so much to read and time is running out for me, as some of the charges date back to January 2001.

I would think you'd actually have to appear in court - but I shouldn't worry overly about that as it's unlikely it'll get to that stage - I claimed back to Oct 2000 & didn't have to - they're settling in full.:D

Hi markgreen,

 

You are highly unlikely to be required to appear in court, the bank will enter a defence on the claim - this bides them time (something they don't have much of at the moment with the sheer volume of all the claims)

They are also testing to see if you are being serious - many give up - the bank knows this !!!

Stick with it, try not to worry, even if the submit a defence, you will then have to submit whats known as a AQ (allocation questionaire) this is so the cort can decide which court to arrange the hearing at, it will cost you another £100, this is added to your claim, so you get it back - the bank will more than likely then either make an offer, or pay in full, daft really they could save the extra £100 + court fees if they just paid at the outset, but that's banks for you - however they will pay up, even if it's at the 23rd hour

babs, been following your thread - it really is like a soap opera.

i really thought you'd hear from them today - friday has always been a busy post day from dg for some reason. i've been thinking about it and i can visualize this poor little mite of a girl called debs in their office with about a zillion piles of files on her desk. it was all going so well...... third week into the mcol, ask them for a breakdown, get an offer out just before the defense is required to be filed and then SOMEBODY got the bright idea to send the breakdown just as they acknowledge. now she has about fifteen different piles on her desk - this one the acknowleged, this one a lesser offer, these with a 100% offer, this pile asking for a breakdown and now all these uncalled for breakdowns have come in (i'm blaming your thread you know!) and breakdown takes on a whole new meaning! maybe debs has had one herself. OR she's decided to personally take it out on you OR she just forgot to get back to you OR your file has slipped under her desk. whatever! don't know what to tell you. except - my fingers are crossed for news in tomorrow's post. good things come to those who wait (i hope you asked for daily interest!).......take care,

Maybe the desk has collapsed under the sheer weight of all that paperwork, and poor little Debs has had to prop it up with a pile of breakdowns and Babs (and mine) are in that wedge !!

 

Maybe Debs has left to sue her own bank (thinking about that - silly idea, solicitors earn shed loads and banks at The Holy Stinking (rich) Bank Copration

yeah, but ask yourself, are they really lawyers at all? dg is the "in-house solicitors firm" they probably take some poor switchboard operator - since the phone stuff all moved to india and told her, ok, now you can be our solicitor, when they ask you for their money, just ignore them, then when they really squawk, make them a stupid offer, and if you really have to, give them their money back. poor debs, she is struggling now. julie ran off with the postie so she's in this alone. i think she's probably being treated for repetitive strain injury to her brain on all these claims. i also think since all who can have gone for the demo today - and the site seems to have gone bonkers - we will just chalk tonight up to silly season! grab that postie manana.
