Lowell tell me they can't refund an overpayment- is this true?

Hello,

 

I'd be grateful for any advice on the following;

 

 

I made payments to Lowell via standing order and have been informed by them that I have now overpaid.

 

I requested they refund the overpayment to a bank account and received the following response:

"Unfortunately we are unable to refund straight into a bank account.

If you are not wanting to transfer the over payment to another account

[they now tell me I have one other open account with them]

you would need to speak to your bank and complete an Indemnity Claim.

This will allow you bank to pull back the funds into your account. "

 

I've never heard of this before and any overpayments

- including standing orders

- have just been refunded.

 

 

Has anyone come across this before?

Of course they can. They're just that greedy they don't want to. They can reverse the transaction or issue you a cheque.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

I hope you've sent these fleecers a CCA request on all the debts you are paying them?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

They're lying, but that's Lowell all over.

 

If it can be paid to their bank account, it can be 'unpaid'.

 

Further to what everyone else has said, I'd also make a complaint to the Financial Conduct Authority.

 

May make a rod for Lowell's back, assuming that the FCA have been contacted by other people who've also filed complaints with them for the same reason.

If they can't substantiate, then the OP ceases payments and then Lowell 're-assign' to some other DCA, would it also be worth filing an indemnity claim for all payments made to Lowell up to that point?

 

Whether the bank actually honours it is up to the bank I guess, but that's what I'd be thinking about doing.
