Quick quid refusing to give me a breakdown

I have been in a debt management plan since Oct 2013.

 

 

I had been paying quick quid through step change,

 

 

when i first started i owed quick quid £764,

 

 

then in around May time my step change balance showed 0 they stopped paying

 

 

when i asked Quick Quid what my remaining balance was they said £500 and something,

saying that when my loan was called in full on 7th Jan 2014 the remaining balance was £948,

and that they didnt know i was in a plan until Jan 2014,

 

 

however, i know that they did as they have sent me a list of payments received from stepchange starting from Oct 2013,

and when they tried to refer my "outstanding" debt to a third debt collector it clearly states that the start of the plan was Oct 2013.

 

 

I have paid them back the £948 but

they are still saying i owe £346.

 

 

I have written to numerous times asking them for a full breakdown of my account so i can see how they have come up with this amount,

 

 

i have sent this recorded delivery and it was signed for by them on 9th June,

 

 

i have also written a formal complaint and as yet still nothing.

 

 

They tried to pass it to a third debt agency but where ive now escalated this complaint to FSO,

 

 

they passed it back to QQ.

Quick have sent me an email saying they want me to call,

i refuse to call as want to document everything,

 

 

now they are sending me threatening emails demanding immediate payment and again threatening to pass my debt on.

I am still waiting to hear from FSO.

 

 

What am i to do, i just want to see where they have got this amount from

but they dont seem to want to provide me with any kind of breakdown,

 

 

am i wrong in not paying what they say i owe ? Help

This should be relatively easy....

Send them a SAR (Subject Access Request) which costs £10, cheque or postal order.

 

They then have 40 calender days in which to respond and send you everything they have regarding this account and this will show up

the figures, and hopefully give you the answers your looking for.

 

Have a look in the library for the SAR template.

If they fail to provide the info within those 40 calender days then you can escalate the matter to the ICO who will hopefully, fine them, and get the documents for you.

 

This smells already, did they ever terminate the account?

And have they stopped adding interest?

Ah i see i didnt realise i had to pay for this breakdown and they have never said i had to either,

 

 

i will do this straight away.

 

 

They are no longer charging interest.

 

 

We are just arging over the total amount owed and what date the loan was called in.

 

 

i say it was £948 in Oct 2013,

they say it was £948 from January,

but without the breakdown its hard to say how they have come up with their amount,

 

 

i would imagine it was interest but for what period, as they knew i was in a plan in Oct 2013

and have said that they froze the interest when it was called in full but then they say they didnt know until Jan 2014, which is not the case.

You dont have to pay for the breakdown at all.The creditor should supply one upon request. However, a SAR forces them to hand over all info they have on you INCLUDING the breakdown.

 

As you've seen, QQ are pushing their luck and trying to get more money from you than they are entitled because they think you are gullible.

You don't 'have' to pay, they could send you the information free of charge. They can charge you up to a maximum of £10, and being money grabbers will always want the maximum.

 

 

If they haven't got the information you require, they could just send back the payment and tell you it's closed, so it would be easiest to use a cheque rather than a postal order as a postal order is prepaid, (plus fee), and not so easy to convert back to cash.

They havent asked me to pay,

 

 

just keep saying if you want a full breakdown you must request this in writing, but

 

 

ive done that (got the proof too from Royal Mail) and still no breakdown,

 

 

got another email this morning, demanding payment and threatening to pass it to another debt collection agency

(although they've done this already and as im in the process of disputing the account they sent it back to QQ straight away).

 

 

Im at a loss of what to do really.

 

 

I wonder will the new rules put in place by the FCA will have any bearing on my case as

 

 

im sure the interest they are charging is more than my orginal loan,

 

 

or is this just for new loans and not exisiting ones?

wait 42 days from date of posting

then launch a complaint with the information commisioner.

Arc europe Ltd, but as soon as i told them i was disputing the amount owed with QQ and had raised a complaint with FSO they soon passed it right back to QQ. Who nw have sent me another email saying they are looking into the issue and it should be resolved in 14 days, however, they sent the exact same email 16 days ago and still no resolution or breakdown!!

I have raised a complaint for the Financial Ombudsman already and am waiting to hear, i had a look on the FCA website about complaining to them but it said to complain to company first and then if no satisfactory response then to complain to FOS, didnt say anything about complaining to them directly?? Can i do this then?

You can complain to the FCA, but they will not intervene on a personal complaint, they will wait until they receive loads and will then take action.

 

Your best route is Formal complaint to QQ head office - if not resolved satisfactorily, then complain to the Financial Ombudsman. This looks to be what you have already done.

 

Do you have a FOS reference number ? If this has not been provided to you yet, you should telephone them and ask for one.

 

You should then include this on any communication you send to QQ or 3rd party agency.

 

Advise them that there is an official complaint with the FOS under reference number 1234567. You should update your complaint with the Financial Ombudsman with any threats / harassment you receive from QQ or 3rd party.

 

Unfortunately, the FOS have one speed.. reverse, so it will likely be some time before you receive a response from them.

Ive done all i can then as i do have a reference number from the FSO and i have been putting that in all my correspondence to QQ, and have also been sending all the emails and correspondence from QQ to the FSO, its when i send this info that QQ send me the 14 day email but they've sent it twice now and still no resolution its driving me mad.

You have done all you can, they have continued to frustrate the process.

 

Let them rot now, ignore them, ''IF'' they ever get the idea of pursuing you through court, your defence will speak volumes.

Wonders will never cease they have today provided me with the breakdown, only taken 5 months. But on the email demand i got yesterday they say my balance was £346 and on the statement says £405, they have taken off £187 as a good will gesture, apparently, but they were still charging me interest and late fees even though i was in a plan, and this amount covers that so not really a gesture as such. Getting there slowly i suppose.

If they have been adding charges and fees, even though you were in a DMP, then IMO they need kicking off it.

 

You can deal with them separately, until they stop adding fees/interest then £1 a month is all I would be paying.

When i first told them about going into a plan it was £744 (wrote to them on 20th August 13), my plan started officially in Oct 13 first payment from stepchange on 26th Oct and by that time it had gone up to £1028, 3 lots of interest added in Aug, Sep and Oct, plus £12 late fees each month, more interest added in November too which after the payment from stepchange they then say i owed £1098, two more late fees in Nov and dec, ive paid them back £948 in total so far.....

Theres at least £48-60 you can reclaim though.
