Thnx Al for that, while your still on, I know what I am gonna say

on this :-

LETTER BEFORE ACTION

Section 7 – Data Protection Act 1998

Dear Sir/Madam

Account: xxxxxxxx

I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated (Insert Date). The disclosure of personal data is incomplete in that at least the following documents are missing.

(Adapt this next section to your situation)

1) You have failed to provide a complete list of transactions and charges.(Add details of missing period - or a transaction that you know about which is not included)

2) You have provided no notes, or documents relating to any legal action between you and myself.

3) You have provided no notes, or documents relating to instances of manual intervention.

This is not an exhaustive list by any means, it is just an example of some of the information I am missing.

Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

You have a further (Insert number of days remaining) days to comply.

Yours faithfully,

But not sure bout the further days remaining, it was 40 days for the sar but can I squeeze them to 14 days???

Also I am not going to use the spreadsheet as previously mentioned ,,, not bothered bout interest and dont wanna go over the 5000 mark

I think that would come under a service, rather than a penalty.

Sorry just a bit confusing £4700 worth of charges is being swiftly diluted to £2600+ :( also no one has replied to the IC charges being left off and whether I can claim that,

Not sure but the surge of enthusiasm and help once prevalent on here is also becoming " diluted"

Yes Al I do mean interest charge, for some reason on this forum if you put those 2 letters together it gives the info commisioner bit strange eh

Bit similar to putting s followed by a followed by r which gives you SAR

The Charge is £30 for each guaranteed cheque

ok got spreadsheet working ok and it works out at £4000+ plus £700 interest. now that is statutory interest.. anyone got any info on contractual interest and how much that may work out figure wise...

Also, anyone gone for contractual interest and won????

as an aside,, my account being over my od limit due purely to their charges...(they have temp stopped the £3 a day charge) I am gonna send this:-

Dear Sirs

Re: Account in dispute

I am writing to clarify that I am currently in the process of requesting a refund of bank charges unlawfully made to my account. I believe that the unlawful charges you have imposed on my account far exceed my current overdraft..

I need to make you fully aware that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved.

If you do proceed by issuing a Default Notice or making any adverse comments on my credit reference files, I shall be forced to take legal action against you under the Data Protection Act 1998.

Yours sincerely,

Should I also suggest that Openplan (who i am dealing with my overdraft problems) contact

Head Office Customer Relations

Barclays Bank PLC

1 Churchill Place

London

to confirm the account is in dispute or would that be taking the PI@@

Delboy you are talking about a lot of money maybe equal to your claim as it stands on top for the sake pf a pen paper and a weekend i think you should reconsider it will take the same amount of time for the claim to go through weather you use Stautory Interest or Compounded Contractual Interest but as i have said the difference could be 50%,75% more at least.

Oh dear I feared someone would say that to me, trust it to be you!! lol

I presume that would take me out of the small claims court into another court or procedure? Not too bothered bout the basic court costs as it seems I may not have to pay them due to various benefits being received (got the form cant find out if I need to send the form off pre MCOL or if it is around £6500+, some form filling in manually )

I have been reading the thread on contractual interest but its way to long and basicly I need to know if there is a s/s on it or if it is done manually?

Might need to find a friendly Mathematician on here with whom I could agree a sum if I win, not if I lose lol all the info is on my google s/s apart from knowing what Contractual interest rate they would charge and subsequently me charge them....

Delboy, if you've put all the info into your Google sheet, then your work is done !!! Like you say, just find out what their current rate of interest is for unauthorised overdraft/borrowing and punch it in, and that's it. The spready works it all out for you !!

If you are exempt from fees, fill it in and take it with you when you file your claim, that is what i had to do. Just check you are exempt as i was claiming working tax credit and child tax credit but was above the thresh hold for court fees and had to pay anyway.

Your annual income has to below £15460 if it is above this you may be eligable for remission.

Best of luck

Karen
