I had a letter from the DWP back in July stating that I owed them £403 from a social loan that I had been paying from JSA.

I am no longer on JSA and wrote back to them making a sensible offer of repayment at a rate I could afford.

They ignored this and the letters and calls from CCS Collect started.

I wrote back to the DWP with a copy of my letter from July and asking why I have not received a response as I wanted to set up a payment plan.

I have just received a response this morning stating that they have passed the file to CCS and I must deal with them directly.

From all the advice I have found on here,

I understand that making payments to a DCA such as CCS is a bad idea.

Can I insist the DWP deal with me on this and let me set up a repayment plan with them?

As they have assigned the debt I assume you are no longer on any benefits...I personally would ignore the above and let them issue proceedings...you have an excellent defence if required.

Thanks

- I now just get working tax credit and child tax credit but am still on a low income and a single parent.

CCS' letter is particularly nasty and intended to scare, headed:

THIS IS A NOTICE OF INTENDED LEGAL ACTION WHICH WILL BE RELIED UPON BY THE CREDITOR EVEN IF NOT READ.

DOCUMENTS ARE NOW BEING PREPARED FOR THE FINAL RECOVERY OF THIS DEBT. (their caps not mine!)

They want me to pay the full amount by 10am on 11th October followed by the usual threats of court action, Warrants of Execution, Bailiffs etc etc

Nice.

Bear in mind that DWP can do straight for an attachment of earnings without going anywhere near a court.

ignore CCS they can do NOTHING to you on a gov't debt.

deal/pay DWP.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I'd love to dx but their letter states quite specifically: 'We are sorry that you have not received a reply to your initial letter. However, as this amount as been transferred to our recovery agent CCS Collect we ere unable to accept a repayment offer from you."

I was really surprised to read that as I thought they had to deal with me if I was making an offer to repay.

You can make your offer through CCCS, they are being paid via tax payers money so make the Bu*gers work for it.

Ha ha, it's the turn of CCS to use the hilarious ''Valid even if not read by you'' statement, brilliant!!

I wouldn't care what they say or do, only deal with the DWP direct.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
