Like to tell my story on ATOS and DWP... Due to my anxiety attacks and depression, and a fear of the outside world. I was due to have a home visit at around 9.30am in July2013. That ATOS person never showed up, I was up and dressed at 7.30am and waiting in panic mode.. I can assure you I had clear vision from where I sat, looking down to my front gate. The gate also had a door bell.

This person never rang my phone or rang my bell, or even entered the gate to my property. Yet claimed they had and I wouldn't open my door.( Rubbish)..

 

 

On the 31 March 2014 I had to go to yet another ATOS medical, where this time I had to go to them in Leicester. I was due to have an operation for a new hip within 5 weeks from there date. Against all issues I had at the time and after, I in severe pain, went to the appointment 15 miles away. On getting there and struggling to walk, when asked into the room, I was made out to be a liar and a benefit cheat, which sent my temper sky high. The woman medical person asked me questions for near an hour, seeing that I was getting stressed out and in pain, as I couldn't get comfortable with my hip, yet not once offering any help to ease my situation.

The various excersise's she asked me to do, and I couldn't bend or stand on my bad hip. She even commented I couldn't do them due to the pain in my hip. After leaving the room, I felt I had been interrogated by the Gestapo and felt worthless and belittled. Two weeks later my Benefit stopped and I was told in a report that was sent to me, I was fit for work, even though I had said I had to go for surgery for a new hip in 5 weeks. Was told soon as operation was done, and I was off the operating table, I was fir for work. even though I had my GP to back me up..

This is my now forth week after my operation, and have two weeks more before I can just use one crutch. They let me have £72.40 per week as I have now taken it to a high tribunral, as I believe I was wronged. How long I have to wait to here I have no idea, but this isn't fare.

DWP asked me to send them all my proof of doctors notes etc. They lost them, so had to start again, this time sending them to the court. Papers that were sent to me from the court from DWP, just annoyed me, as they copied a lot of what I put in my defence, that they said they lost, into there own words, to make me look bade.. So I wrote to the court stipulating what they had done, now its a waiting game..

So your appeal is awaiting a Tribunal date, well please don't hold your breathe as I had to wait almost 2 years from the start of my Tribunal appeal until I attended the Tribunal hearing.

I would suggest that you get yourself an Advocate, who should help you gather all the proof you require and help you with any communications in the mean time. An Advocate usually knows all the "buzz" words to use and also how to word all the salient points in a way that stops DWP twisting what you have said.

As and when the Tribunal hearing occurs an Advocate can be invaluable in stressing points for you or to step in should you become over anxious or stressed.

Irrespective of how long you wait for your Tribunal hearing, should your appeal be successful then all unpaid benefits from the date you started your appeal will be backdated and paid to you.

Unless you have opted to accept a short notice cancellation date then I'm afraid you will have a considerable wait, other that that Good Luck with your appeal.

I was told it would be a 29 to 33 week wait... I see that ATOS contract was finished in January 2014 with a £500.000 pay off as they messed up with DWP.. So what puzzles me, then why was I asked to go for a medical on March 31st 2014...

 

 

This whole system is one big mess, this govt has really cocked up big time

I think theyre still doing it until the end of 2015, they got out of the contract early is what I have heard. Any appointments with them for me would have to be recorded. They do lie when they can and they know what they are doing. Its disgraceful and I dread what will come in to replace them, one thing is for sure it wont be better for the sick........
