      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

Today I checked my credit report with noddle (it's free) and

 

I noticed I have one default account which has been registered with PRA.

 

Concerned I checked Experian and there is same information.

 

Both of them are relating to my old debt with QQ which has been taken over by Mackenzie Hall.

 

I settled this debt in 2011 and I've requested a confirmation letter from MH, which I still have a copy of.

 

I was working really hard over last 3 years to build my credit score once again.

 

Could you please help me what should I do and how should I deal with PRA.

 

Dates and ammount on the letter and credit report are exactly same.

 

Also I am 100% sure I've settled all my debts from the past.

PRA is MH's parent company.

 

if you paid the debt off

it doesn't remove the default sadly

But balance is still showing as £296 that apparently I owe them. I found a letter on experian website, should I send it to them ?

yep send PRA a copy of the MH letter proving you have settled the debt too.

It's 26/04/2011 as per screenshot in attachment. Either MH did not update my account or after being taken over by PRA something went wrong and this is showing a balance now.

To my knowledge there has a number of instances such a this all stemming from the time PRA acquired MH and began to amend CRA records with their data.

 

 

Follow dx100s advice, personally I would get " Notices of Dispute/Correction " placed on all the CRA entries.

 

 

You may get the balance changed but as dx said the default entry will remain for the balance of the 6 year period.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Thank you very much for an advice. I have contacted today PRA and I was assured that this is an error in their system. As a confirmation I've send them an email with official letter requesting change of my account status on my CRA and with letter from MH that account has been settled. I was informed by PRA employee that if I will receive any phone calls from PRA I should simply ignore it. I was assured that my CRA should change in the next 2 weeks.

 

@dx I either paid off the full amount or agreed amount which was offered to me by MH. I can't recall it now and I will have to get a bank statements from my previous bank to get all the details.

 

Obviously I will inform about any outcome. If there is anything else I should do to make sure this has been resolved please let me know. If I will not receive any response via email I will send letter and a copy of account statement from MH via post.

 

@BRIGADIER - I am ok with default status of my account as long as balance will change. I have 2 defaults from 2011 and this should disapear from my CRA in 2017. If this will not get corrected I will struggle until 2020.

Umm no. They should NOT be calling you at all. Never mind still calling you but saying to ignore it.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They still should cease the calls, automated or not. If they can't, then their systems are not fit for purpose.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
