I assisted my sister with an appeal to the PATAS after she was issued with a PCN for parking in a residents or shared use parking space or zone without displaying a valid permit or ticket, or after the expiry of paid for time (Contravention Code 19) as her permit was rolled up and was not displayed properly.

 

I argued that the council applied the wrong contravention code and that the appropriate contravention code should have been Contravention Code 12, namely for parking in a residents or shared use parking space or zone without clearly displaying a permit or voucher.

 

The Independent Adjudicator accepted my argument and allowed the appeal.

 

Anyone else had a similar response?

I'd agree that code 19 is wrong. It's for when you have displayed a voucher etc for that place, but there's something wrong with it - eg it has expired.

 

In your case, if the permit could not be read, the CEO could not determine if it was a suitable permit for the bay, and should have issued a PCN for not having anything at all on display - code 12.
