Question about Prelim

I would like to add a paragraph to the following section, just so it covers my (and maybe others) circumstances.

 

"Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account.

 

In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable."

I would like to say something along the lines of.... that any default registered by you would be illegal and invalid as the total which was registered includes unlawful and illegal charges, therefore the default is incorrect and, bla bla..

Anyone come up with a professional sounding/jargonated one? and does this sound ok to use?

You can try this but it makes it more likely that the bank will try to defend the claim. As an alternative you could get your money back first and then go after them for the default.
