Hi Guys

 

Needs your help, Im stuck with PaydayUK after someone fraudulently set up a Payday loan in my name.

 

This all from my credit file review for my SC clearance, but after digging deeper the information used doesnt correspond with my Bank account at the time.

 

Attached is a Letter which i have received from them. This has been registered with Actionfraud and all steps taken but they essentially are making it difficult and i dont know what next steps to take as they have referred it to their complaints team.

 

FYI. The person who did this, shot like a lemon when i discovered it and because it was a housemate (Although i knew virtually nothing about him) It was kind of close to where i was living at the time.

 

They claim that the loan was taken out, paid back and then taken out again...

This was back in mid 2011. I was frequently out of the country during that year in Spain.

 

Where do i go now? Their complaints team are dragging their heels...Making it difficult.

Hi,

They are stating that the funds went into your bank account. I assume this is not true.

 

This can be easily proved by telling them that you have never had an account with the number they have.

 

Remind them that payday loan companies are under deep scrutiny by the FCA and you will not hesitate to add your name to the list of complaints.

 

Credit companies also have a duty to ensure the data they place on credit files is accurate. You have told them this was not you. they should investigate this quickly. Unfortunately, with it being with the complaints team, they have 56 days to resolve this and if they still don't agree this wasn't you, you will have to escalate this higher.

 

Have you placed a notice of correction on your credit file?

If you are asked to deal with any matter via private message, PLEASE report it.

Not yet, I havent put a NOC on my credit file yet because im trying to get this sorted direct with them. They have a Fraud Investigation Team who look at all this as per the attachments.

Ive already told them that the account was never in my name etc, and they said well speak to the bank they will give you the funds to pay this off? Personally i think thats disgraceful.

 

Ive already dealt with Minicredit, who looked at the hard facts and made a decision very quickly!

This has been referred to their complaints team and i get itll take upto 56 days etc. I will attempt to escalate this higher when they come back to me.

 

Honestly SF... They dont care whether they are under scrutiny, They are just content on ruining peoples lives.

You probably know this already but in accordance with the Fraud Act 2006 the onus is on them to investigate the alledged fraud, and not you. If they are refusing to do so then you'll need to involve the FOS for sure. A note to the FCA wouldn't hurt also. Of course, if any of this is causing any tangible harm to you, it may be possible to bring an action against them for their failings.

Yep i know, but the problem is i have had to supply a Witness statement to them.... which is attached.I don t know what you guys think,. but ive already filled this in previously.

 

Apparently this is not the only account... Ive just had Wonga email me back on another that was paid into this same account. Problem is that Lloyds wont send me a letter confirming the account was set up without my consent.

Of course they won't. It's deeply embarassing for them. There are very stringent rules around opening accounts. They should have robust checks and balances to ensure stuff like this doesn't happen. Yet it does. It's alarming to say the least.

 

But you know all of this already.

Yeah I do , Its already gone to Actionfraud... My concern is that they will just say... Its yours, even though its clearly not and i will have to see a Black mark on my credit file for the next 3 years....

Actionfraud are just a reporting function, they won't investigate at an individual level.

 

I would ask Lloyds for information around the proof they required when the account was opened. Do they not need photo ID?

Not necessarily when discussing this with lloyds they advise proof of address and birth certificate was acceptable...

Problem is i kept all my documents in my room in a folder all together!

 

Also another thing, Id left lloyds by Jan 2011 and went to RBS, However as i had left, I had no idea this had happened.

That's a fair old point... No I haven't... But then again my SC has been completed and granted...

 

Actually... I lie... I have told them about it... And that it was in hand...

 

When I completed my financial questionnaire (further info), I mentioned about these
