My life insurance was cancelled by HSBC due to their fault.

When I contacted them, they originally claimed it was done as per my instruction.

They wrote a letter to me confirming that after their investigation they can confirm I cancelled the insurance. In the mean time I was not insured an need to fill in a new Health Questionnaire.

 

 

After several phone calls and they keeping to their version of event, they have now finally accepted that it was an error on their part. In the mean time I have arranged another Life insurance with a different insurer

 

 

Now my questions are:

1. Is this a breach of Contract?

 

 

2. Can I claim back all my premiums over the last 4 years I have been paying?

1) Yes, they have cancelled without using any valid reason a cancellation clause may provide them with within the policy terms.

 

2) Not necessarily, but they would have to compensate you for any loss you had suffered as a result of their mistake. You would have to indentify what loss you had suffered.

 

The way to deal with this, is a formal written complaint to HSBC providing details of the loss you believe you have suffered as a result of their mistake. Ask them to reimburse you for the loss or if they do not agree a full written explanation of their position, so that this may be considered by the FOS, if the complaint is escalated to the FOS.
