I have a simple question ...

 

 

Can a Bank do the following to me without any notice whatsoever?

 

I did not know I was overdrawn and

had a bunch of money in my other account,

 

it would have taken me a second to transfer if I recd. a notice.

 

All these were slapped on me on a single day.

 

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00 £1,050.33

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00 £1,075.33

Brilliant, I have read around the forum but am a bit confused about the exact template that I would need in order to draft my letter to the bank.

 

This is about a current account that went overdrawn.

 

Am I looking at the right template here?

I had read the entire case but I did not find it to be a similar situation as mine. The bank in question is Santander and they have not sent me any letters whatsoever. I only went to my online statement and noticed that they have slapped the above charges.

 

The RBS thread, although about unfair treatment does not point me towards the kind of letter I need to send to Santander. Yet, I will lift some key points mentioned by that person and draft a letter tonight and post it here for you to look at.

well as they to my knowledge

have caved in 5 times using bcobs

 

you should be in luck

Here is what I have drafted after reading a whole lot on the CAG forum. Please spare a moment and scan it for any errors or amendments.

Date : 05th Feb 2014

 

Dear Sir/Madam,

 

I refer to the default charges applied to my account which amount to £120.00. Their break up as follows :

 

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00

31/01/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00

31/01/2014 UN-ARRANGED OVERDRAFT USAGE FEE £20.00

 

I believe that these charges applied to my account are unfair and do not reflect the true cost of my account going into unauthorise overdraft. There was no written or verbal notice given to me about my account going into overdraft before and after these charges showed up on my online account statement. This is against FSA guidelines and is not permitted under the BCOB.

 

I therefore ask that you repay the amount of all these charges.

 

If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs, without further notice.

Just as a side note : I am not in Financial Difficulties. I hope that does not go in favour of Santander. Also, this is a current account with a Debit Card, I hold no Credit Card on this account.

So sorry for being dumb,

 

I have read the RBS BCOBS link several times and returned very confused as to how that person's case is similar to mine

apart from the fact that s/he is talking about unfair charges. T

 

hat letter appears to be written by someone who has been corresponding with a bank for a while.

 

I hope I am looking at the right link, please confirm :

I received the attached letter from Satan a couple of days ago.

 

They meanwhile slapped me with the following charges ...

 

04/03/2014 PAID TRANSACTION CARD PAYMENT TO xxxx £25.00

04/03/2014 UNARRANGED OVERDRAFT USAGE FEE £10.00

 

What should I do now?

they cant apply fees because you had fees that put you in OD that they have now refunded?

Their letter (attached in the previous post) says ...

 

Please be aware that these are fees that are due to debit your account on 4 March

2014, totalling £35.00 and I can confirm that these fees have not been applied due to

your previous fees.

I am in receipt of your letter dated 3rd of March 2014 wherein you have extended a Gesture of Goodwill refunding similar charges you had applied to my account in the month of January 2014. This letter also informs me about your intention to apply the aforementioned charges to my account, which you did on the 4th of March 2014 while the letter was still in transit and hence not received by me. Also, do I understand that you plan to continue to breach FSA guidelines and BCOBS rules?

 

I never opted for an unarranged overdraft usage facility or gave my permission to you to pay for my transactions. I hence feel that I have been treated unfairly by someone I held in trust.

 

I therefore ask that you repay the amount of all these fresh charges and discontinue the overdraft facility from my account with immediate effect.

 

If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs, without further notice.
