Hi, Im brand new to this forum and would appreciate a little advice?

 

I'm in a lot of debt problems and I'm only just starting to face up to them and deal with it.

 

a year or so ago i ordered from a few catalogue companies, one being Fashion World...i think the whole company comes under JDWillams ltd.

 

...anyway i have been getting letters and phone calls and now today a letter to say someone will be "making an appointmnet to contact me at home" today, which I'm sure is just to scare me into doing something, but the reason i need advice is that i have never signed a credit agreement with them, i ordered stuff...they sent it out along with a credit agreement for me to sign and return which i never did at the time.

 

so where do i stand in terms of my debt with them if i never actually signed a credit agreement? i would really appreciate any advice i can get, i live alone and I'm struggling to face up to my mistakes and deal with it all the last thing i need is people calling at my door asking for money.

yeah i didn't sign anything....i have really bad credit and was surprised when i signed up for fashion world and it said my credit limit was £150....being the awful compulsive shopper with a debt problem that i am haha i maxed it out within a few orders, then a week or so later i got a letter from them with my 1st statement and a credit agreement that said i had to sign it and return it to them, seen as i had already maxed it out and had other things and debts to pay for i just ignored it (stupid i know)

 

looking at the account now its at around £233 with multiple £12 service charges that they have added on over the months.

 

I'm just not really sure what to do now? do i contact them, do i pay it back, do i ignore it? i just don't know.

 

I'm really scared of someone turning up at my door so i don't want that to happen.

You can reclaim those penalty charges... If already paid... Etc

 

These fees are unlawful. Sorry for being so silly before... I understand now.

 

They should have got you to sign the CCA agreement BEFORE issuing goods out etc.

 

If someone turns up at your door then you can tell them to leave...

 

They are DCAs lakkies who have no rights.

As for not signing an agreement, you have ordered items, and they will be able to prove this, so an agreement won't matter.

However, the penalty fees/charges can either be ignored entirely, or reclaimed.

But you will need to come to some arrangement with them in order to pay for the items.

 

Contact them IN WRITING, and arrange a repayment plan, but it is on your terms, at a rate which is suitable to you, NOT them.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

fkofilee thanks so much I've been reading up about these door visits and realise now they have no power! so will be telling them to do one if they do turn up! haha!

 

Bazooka boo thanks for that link, its printing off now. i have done a bit of research on these fees/charges etc and I'm gonna just communicate with them by letter like you said and sort out a repayment plan with a small amount a month and claim back them fees and charges!

 

Thank you all for your help!! i can't say how grateful i am, this forum is amazing and will hopefully help me get my debts sorted and tackle some of my other problems....my next task is dealing with Lowell, whom I've heard are a pain in the bum! haha!

Oh they are just **** aren't they!! they are after me for a O2 mobile phone debt...of which i have no idea where its come from. I'm the first to admit i have awful credit and I have a lot of debts with different people but i have no recollection of this debt they are after! I've heard that they buy old paid off debts and try and get you to pay it again. i currently have not communicated with them at all...and I'm not sure how to really, was hoping they would just bog off if i ignored them enough! haha! but they ring, email, text and send letters all the time, its like harassment! haha!

It IS harassment, it IS a criminal offence.

You really do need to be reporting this to all those who claim to police this industry,

and keep a diary of events regarding their harassment so you can report them to the Police

with a view of taking legal action against them for said criminal offence.

 

Be aware that lowlifes are getting quite litigious of late, so if the amount they are claiming you owe is substantial then expect them to issue you with a summons at some point.

However that doesn't mean you need panic, because you seriously don't, just be aware of just how corrupt this industry has become now that people are beginning to kick back.
