Hi, EOS solutions have been writing to me regarding a debt they say I owe for a Witt catalogue from 2008. From the statements they have sent me the last movement on the account was June 2008 when they sold the debt. I asked for a copy of the CCA and received this back

Is this enforceable?

The question is.. not if it is enforceable, but.. Did you sign something like this when you entered into the agreement ?

 

Other questions are, when did you enter into the agreement - if 2008 then it would be after the amendments made to the CCA 1974 act.

 

It looks to me as though the account might have been opened prior to 2006 because they have mentioned default charges at £25.00. The OFT required creditors to reduce their default charges in 2006.

 

 

However, they do state in their accompanying letter.. that as they are unable to provide a "signed copy", they will not be taking legal action to enforce. So the worst you can expect would be telephone calls (which you can prevent by sending the telephone harrassment letter from the CAG library) or loads of letters. They could assign the account to a 3rd party. You might want to keep the letter somewhere safe, just in case a 3rd party chances their arm with court action.

Thank you for the reply. I don't remember getting anything from them at all to be honest. This is the first I have heard of anything like this. All my other debts are being paid off but I know nothing of this one thats why I requested a copy of the agreement.

Id be interested to see this... BB has asked the right question here...

Id laugh at them for them buying a lemon to teach them a lesson but then again we dont condone Debt avoidance hehe...

 

On a serious note the ball is in your court... Pay them if you want to settle it, but do it direct to the creditor.
