Lies from MBNA

Wrote to MBNA on the 11-08-2006 asking for a full list of charges for an account that was open from 1998 until 2002.

 

Letter back dated 20-09-2006 giving a list of charges dating back to Sept 2000 (6 years).

 

Wrote back on 22-09-2006 saying I wasn't happy that they had not properly compled with my request.

 

Recieved a letter dated 19-10-2006 confirming the dates on which the account was opened and closed and an even less complete list of transactional data (to October 2000).

 

Spoke to Paul Miney at MBNA today who told me that "The data protection Act only requires us to give you 6 years woth of information and says you can only claim charges back 6 years". That's news to me!!!

 

Final word to him on the subject was that either I get an assurance by the end of the day that details of all my charges would be provided to me or I'd get the Court to require their production.

Just found a message left for my by Paul - apparently they now can comply with my request and I should have the information within a couple of days.

I'm new here but as far as I'm aware you can only claim back for 6 years worth of charges, however I'm unsure about how many years worth of statements you can ask for?

You can ask for any information they hold on you, regardless of the age of it. This is the whole point of the legislation - so you can find out what information people are holding on you.

 

With reference to the 6 year limitation on claims - do a search on here. Current wisdom, which most seem to aggree with, is that you can go back beyond that.
