Hi,

 

Apologies if this is covered in other threads.

 

I had a bike accident on 7th June 2013 - my 50cc Vespa was written off - minor injuries - other party admitted liability.

 

My insurance stopped on 24th June 2013 - I obviously didn't renew.

 

Bike was salvaged by insurance company.

 

Two weeks ago I got a Failure To Insure notification - naturally I appealed.

 

Now am shocked to find my appeal was rejected and have a £100 fine.

 

What can I do?

What information did you send in for the appeal ? Did you send in confirmation of the write off from the Insurance company, which confirmed the date ?

 

I think you are being fined purely for an administration failure, which you are being held responsible for. I think DVLA expected you to contact them before 24th June 2013 or ASAP after that date to register the bike as SORN.

 

I think this is awful, but it is the way government have legislated so that DVLA can earn money from people.

 

Advice is to pay the £100, before it gets out of hand and this is taken further with bailiff costs added. It would not stop you taking your complaint further, perhaps by contacting your local MP about it. I think once you have appealed and lost, there is no easy process to remove the fine.

Some dates are missing from the jigsaw -

 

Date of accident - 7 June 2013

Date of Insurance expiry - 24 June 2013

Date Insurers agree Write Off -

Date V5C/3 (yellow tear off strip) sent to DVLA -

Date all remaining parts of V5C given to Insurer -

 

As an aside, when would/did the Road Fund (Tax) expire and was a repayment claimed by OP or was it just part of the wreck taken over by Insurers?
