Hi all

 

Need some advice and guidance with dealing with MBNA.

 

 

Recently contacted them to claim back all charges applied to my credit card account as per the transaction list provided after a SAR.

 

 

I received what appears to be a generic response detailing OFT charge guidance after 2006 and that they adhered to the same.

 

 

MBNA go unto say that they are only reviewing activity over the past 6 years as per the limitations act 1980.

The charges are dating back to 2003 and I wasn't fully aware of the same until the transaction list was provided!

 

What is the best course of action to fight this response?

 

 

Is there any other laws/rules that counteract the limitations act 1980 as it appears to be protecting the credit card company!

 

 

ideally I need a strong argument to force MBNA to go back more than the last 6 years

and repay charges equalling £30, 25, £50 each time!:mad2:

 

I was claimed 8% on the charges, but see from other posts Restitution is mentioned.

..is this applicable to me and what is it? :?::?::?:

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
