Hi All,

 

Well just helping a close family member,

 

2 years ago my Dad was declared bankrupt and the Halifax joint account was over drawn by £1k.

 

Therefore my mum who is 75 had been paying £5.00 month and the debt has never reduced and is now £1,500.15.

 

Due to illness my dad has had to finish work following some under lining heath problems and now started his treatment.

 

So they have no income apart from state pension,

they have had to claim benefits to pay rent etc, but can not pay the debt.

 

We have written to ask for the debt to written off as a 75 lady no job no income and partner with no job also 70 can repay.

 

Yep they refused and state she has to repay in full.

 

What can we do to help,

 

the statement Idem sent shows fees charges etc,

or should we wait for the court action by not paying,

they have no assets or funds

 

Can anyone help at all

Are the charges you mention those placed by Halifax, or have they been placed by Idem or others?

 

I will draft a letter for you if needed.

do idem own it or just collecting?

 

I suspect they own it and haliprats sold it years ago.

 

idem should not be adding anything.

I think this is another case that needs to go straight to the top, a 'polite' but very firm missile oooops meant missive to Mr Richard Woodman the UK MD.

and send idem a notice of authority too

 

pers i'd be stopping payments and forcing their hand

Yes the account which was a joint bank account was included in my fathers Bankruptcy

however as it was joint my mum is fully liable to repay in full.

 

 

we have asked for the debt to be wrote off but the Halifax refused and then sold to debt to Idem.

 

 

Who have added fees and asked for income details and assets.

 

At the present time payments have stopped and its a waiting game,

not sure if they would take action like court then bailiff on a lady over 75 who is unwell

She would be classed as a vulnerable person a bailiff would have to stand down and hand any warrant back.

No the outstanding balance was included in my dads BK,

 

 

however as it was a joint bank account and overdrawn within the Halifax overdraft limit

the debt in full is now my mums issue.

 

 

Will scan copy letter next week which idem sent stating points out etc etc.

my mum has had a letter today from Idem demanding to know her income,

 

 

shes 74and only gets 66.00 wk from the state,

 

 

they refuse to accept the debt has to be written off it will never be repaid.

 

 

They called on friday to which she told them to discuss the matter with me and they hung up.

 

we are thinking now its best to keep all the letter and wsut and see,

even if it went to court dont think the court would enforce the debt.

or has anyone else got any feedback to the next stage.

Well after writing to idem asking for cca got nothing back,

asked for assignment of debt nothing back.

 

Now they ring my mum every day.

 

Claiming they will pass to debt collection company ?

 

And stated they will get repaid.

 

What action if any can we do now

pers i'd be reporting them to everyone I could

 

it appears they have been fleecing a pensioner out of money for years

that they had no legal right too?

 

or that she never owed in the first place?

idem are a debt collection company!

 

something smells here bigtime.

 

how about an sar off to haliprats?

 

even if its a joint account

the BK should have wiped it

if it was included in the BK paperwork...

 

can you prove this?

 

surely the only way the balance would not be £0 after BK

[iF it got wiped in his BK]

 

is if she/they used it again after BK?

if the debt was included in the bk there should be no debt surely?

Well got a reply from Idem today, we requested the debt be wrote off as my mum who has no income apart from state pension. Well they refuse and are demanding full income details including copy bank statement showing the payments.

 

This is driving me mad now, at present they have no income both my parents only get state pension, they get housing benefit and council tax

and that's all, they still have to find gas electric and water rates. So Idem will not accept they can not afford to pay the debt.

 

Just need to write yet another letter cheesed off with the clowns, they even said i should pay to stop the action

So has Idem been sent full income details and copies of bank statements to support this?

If your parents don't have any income to allocate to the debt then you need to show Idem this. How else are Idem expected to to know (and actually confirm) what can be afforded?

Just up dating, we sent IDEM the income detailing which clearly shows that their is no income only state pension. they wrote this week confirming the income was not accepted however they are willing to freeze the account for 3 months as long as my mum signs the letter headed Acknowledgement of debt. They have started to call the telephone land line 5 /6 every day, and when my mum answers they say nothing and hang up.

 

We have sent a letter requesting no telephone calls but they just ignore our requests.

 

Anybody got any feedback on the next action we could take.

Make a Formal Complaint in reference to Idem not giving proper consideration to the "common statement of income" (Find the name of the MD / CEO, to address this to, use signed for post) my guess is this had probably got no further than a desk jockey in "collections" or "customer (dis) service who only has a company script to follow.
