Hi

 

My husband received notification that a CCJ would be issued (debt from MBNA of £3,500).

 

Sought advice from CAB and sent details in that showed he would not be able to make a payment.

 

Next got a letter stating CCJ issued and full payment due - no notice taken of budget info.

 

My husband contacted Blake Lapthorn - he has mental health problems - told to send in evidence.

 

Sent it straight away in July - by Recorded Delivery and Fax.

 

Nothing heard since until today when letter received stating they have not received medical evidence and seven days to send it in.

 

This issue is really causing a lot of anxiety

 

- any advice would be appreciated.

did he get the COURT claim forms to return?

 

has he been sent a copy of the judgement CCJ by the COURT.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi

 

Yes.

 

He took the court claim form to the CAB who said that he should accept the debt

but send budget statement which showed no money available.

 

The next thing he got was a copy of the judgement from the court

 

- he thinks it was from the court but might have been Blake Lapthorn stating that the judgement had been entered

and he had to pay the whole amount in one go.

You can make application using the N245 (fee £40) to vary the forthwith to a monthly payment plan.Complete the I&E on the N245 with your proposed mthly payment.
