carter/fredrickson threat-o-grams on wifes HSBC debt from 2004

Hi,

 

my partner received a letter from Bryan Carter llp today

stating he has been instructed to write regarding an outstanding debt.

 

Its being chased by lowell financial ltd, passed on to Fredrickson itl.

 

It is owing to HSBC for an overdraft of £1006.18.

 

We have checked her credit report and nothing related to this is showing

as the account should have been defaulted around 2004.

 

There has been no acknowledgement of this debt for at lest 8 years

so my guess that is should be statute barred.

 

What is the best course of action with this joker as his letter is stating he will recommend court proceedings

if full payment is not received in 14 days,

normally I would ignore letters like this but the wording is different from others.

Send them the statute barred letter. You need to do it quick as lowell/BC will issue proceedings. If you are 100% sure there is a clear 6 years ( 5 in scotland) with no written acknowledgement or payment, then the debt is 100% SB and that is a complete defence if the muppets tried court.

 

BC is a solicitor for rent. He will simply issue the court papers then back off at ANY sign of a defence leaving the creditor to pick up the pieces.

There has definatly been no contact from us so if there is any question over it they will be lying.

I would send to Lowells (Head Office Address) , with a copy to Bryan Carter. Send recorded delivery to Lowells and obtain a free proof of posting for the copy to BC.

It will definitley come away without a hitch. SB is an absolute defence, although Lowells may come back with the old " a small payment was made in Sept/Nov 2007 or March 2008, so the debt isn't SB." excuse.

It has now been 12 working days since I sent the statute barred letter. I have not yet heard anything off them, do thay have to reply or haveI heard the last of them?.

Had to edit as i misread.

 

 

Chances are you will never recieve a reply. They'll just sell the debt on, which is a breach of OFT guidance. If they do reply, then they will probably do as i said before, and invent a payment.
